RESOLUTION NO. 69-1 ACCEPrING FORMAL AMENDMENT TO GRANT AGREEMENT AND DECLARING AN EMERGENCY WHEREAS, the City of La. Porte, Texas, acting by and through the Mayor of the City of La. Porte, Texas, did execute and deliver that certain Grant Agreement dated October 18, 1957, as identified with Civil Aeronautics Administration Project No. 9-41-159-0801, La. Porte Municipal Airport, La. Porte, Texas. WHEREAS, subsequent to the execution of the aforementioned Grant Agreement, it was determined that the Agreement should be amended to delete the acquisition of land under the project, detete Special Condition 8(b) and substitute a revised property Map Exhibit nAn dated November 3, 1968. WHEREAS, a formal amendment to the aforementioned Grant Agreement, identified as Amendment No. 1 to Grant Agreement, providing for the deletion of the acquisition of land, the deletion of Special Condition 8(b) and substituting a revised property Map Exhibit nAil dated November 3, 1968, has been executed by the Area Manager, Houston Area, Federal Aviation Administration and submitted to the City of La Porte, Texas for acceptance. NOW THEREFORE" BE IT RESOLVED BY THE City Council of the City of La Porte, Texas, that the Mayor of the City of La Porte, Texas, Honorable H. P. Pfeiffer, be and he hereby is, authorized and directed to accept ,a.nd execute the formal Amendment, a copy of which is annexed hereto and made part hereof as if set forth at length herein. . . ..-. .- . WHEREAS, the Area Manager; Houston Area Office of the Federal Aviation Administration, has determined. it to be in the interest of the United States of America that the Grant Agreement between the Regional Admin- istrator, Region II, of the Civil Aeronauttcs Administration, acting for and on behalf of the United States and the City of La. Porte, Texas (hereafter referred to as "Sponsor") accepted by said Sponsor on the 24th day of October 1957, relating,to the La. Porte Munici:pa1 Airport, Project No. 9-41-159-0801 be amended as hereinafter provided. . NOW THEREFOBE WITNESSETH: Tha~ in consideration of the benefits to accrue to the parties hereto, the United States of America on the one part, and the Sponsor on the other part, do hereby mutually agree that the said Grant Agreement shall be and hereby 'is amended: 1. By revising the description of the project as set forth in the second :paragraph, page 1 of the Grant Agreement, to read as follows: Pave WISE runway 75' x 3500' and construct segmented circle marker. 2. By deleting Special Condition 8(b) as set forth on :page ~ of the Grant Agreement. 3. By deleting the property Map Exhibit "A" incorporated into the Pro.1ec1; Application and Grant Agreement by reference thereto and substituting ., therefor the attached revised property Map Exhibit "A" dated November 3, 1968. ' It is understood and agreed that the maximum amount of the obligation of the United States payable under said Grant Agreement shall not be increased or decreased by this Amendment. " .
