ORDINANCE NO. 915-KK
AN ORDINANCE GRANTING A PERMIT UNDER SECTION 18-a-3 OF ORDINANCE NO.
915, "PIPELINE TRANSPORTATION," BEING CHAPTER 18-A OF THE CODE OF
ORDINANCES OF THE CITY OF LA PORTE, TEXAS, DATED NOVEMBER 25, 1975,
TO CONSTRUCT AN 8-INCH PIPE LINE FOR THE TRANSPORTATION OF ETHYLENE;
AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAPORTE:
section 1. The City Council of the City of La Porte has
received an application dated April 24, 1993, from MOBIL CHEMICAL
COMPANY, requesting a permit under section 18-A-3 of Ordinance 915,
being Chapter 18-A of the Code of Ordinances of the City of La
Porte, to construct and operate its 8-inch pipe line for the
transportation of ETHYLENE, crossing the City of La Porte, all as
shown on said application. The application of MOBIL CHEMICAL
COMPANY has been reviewed by the city's Director of Public Works,
who has found that said application meets all requirements of said
Ordinance No. 915, and has recommended its approval.
section 2. The City Council of the City of La Porte hereby
approves the applicaton of MOBIL CHEMICAL COMPANY, dated April 24,
1993, and this Ordinance shall constitute a permit to MOBIL CHEMICAL
COMPANY to operate said pipe line within the City of La Porte, all
in conformance with the requirements of said Ordinance No. 915,
contingent upon its filing with the City of La Porte prior to
commencement of construction, copies of its permits from the Texas
Department of Heghways and Transportation; Harris county; and the
Harris County Flood Control District. Any future relocation of the
pipeline herein permitted, within the City, State, or County rights-
of-way, shall be at the sole expense of permittee.
section 3. This Ordinance shall be in full force and effect
from and after its passage and approval.

SUBJECT: Pipeline Permit Ordinance
Mobile Pipeline
I have reviewed the attached request from Mobile Chemical Company
to construct an eight (8) inch ethylene pipeline in the City of La
Porte. The proposed pipeline will operate at a maximum pressure of
1440 psi, at ambient temperature. The request meets all of the
requirements of Ordinance 915.
The Company will deliver, to you, a check for $500.00 to cover the
permit and the first year fees. Upon receipt, please have the City
Attorney prepare an ordinance for the permit. I have attached an
Agenda Request for the next available Council meeting.

Mobil Chemical Company is in the process of acquiring the necessary
rights of way and permits for the construction and installation of an
8-inch pipeline for the transportation and delivery of ethylene to
the Aristech Chemical Company in LaPorte. This pipeline begins at
Mobil's Houston Olefins Plant located on the south side of State
Highway 225 near Goodyear Road and travels in an easterly direction
within the right of way the Southern Pacific Railroad and the Port
Terminal Railroad for the most part. There are, however, individuals
and privately held companies whose properties the pipeline does
traverse.
Dear Mr. Gillette:
I have included two sets of Mobil's alignment sheets S-268-23 through
24, inclusive, which shows the alignment and location of the pipeline
in the City of LaPorte. Additionally, I have included a copy of a
plat which shows the proposed crossing of Underwood Road. This plat
has also been submitted to Harris County.
Please review the drawings and consider this letter as Mobil Chemical
Company's request for an ordinance to be passed by the City of
LaPorte granting a permit to construct, lay and maintain this
pipeline. All pertinent information with respect to the design of
this pipeline is shown on the alignment sheet.

Pursuant to section 2 of the captioned ordinance, please find attached

1. Texas Department of Transportation Permit Number 93-8961 for
the crossing of state Highway 225
2. Approval of the Harris County, Texas Commissioner's Court for
the crossing of various streets
Mobil Chemical Company's project does not cross any drainage facilities
within the city limits of the City of La Porte, therefore no materials
from the Harris County Flood Control District are included herewith.
This submission should fulfill Mobil's responsibilities as set forth in
the captioned ordinance. However, if there is anything which has been

THE REQUIREMENTS ITEMIZED BELOW ARE ONLY A SUMMARY OF THE BASIC
REQUIREMENTS OF THE ORDER OR SOUND ENGINEERING PRACTICES
GOVERNING THIS CONSTRUCTION. THE APPROPRIATE COMMISSIONERS'
COURT ORDER SHOULD BE CONSULTED IF ADDITIONAL INFORMATION IS
NEEDED.
1. THE CONTRACTOR MUST PROVIDE WRITTEN NOTIFICATION TO THE
HARRIS COUNTY PERMIT DIVISION OF THE ENGINEERING DEPARTMENT
FORTY-EIGHT (48) HOURS PRIOR TO COMMENCING CONSTRUCTION.
2. NO MORE TRENCH SHALL BE OPENED AT ONE TIME THAN CAN BE
BACKFILLED AND COMPACTED IN Ion LIFTS AT THE END OF EACH
WORK DAY. (NO TRENCH SHALL REMAIN OPEN OVERNIGHT).
3. ALL EXCESS EXCAVATION SHALL BE REMOVED FROM ROAD
RIGHT-OF-WAY AT THE END OF EACH WORK DAY.
4. DITCHES SHALL BE OPENED AT THE END OF EACH DAY OR WHENEVER A
THREAT OF RAINFALL EXISTS TO ASSURE ADEQUATE DRAINAGE.
5. ALL ROADS MUST BE KEPT OPEN TO TRAFFIC AND THE CONTRACTOR
MUST PROVIDE ADEQUATE FLAGMEN, SIGNS, SIGNALS, ETC., TO
PROVIDE COMPLETE SAFETY TO THE PUBLIC.
6. IF IT BECOMES NECESSARY FOR EQUIPMENT TO OPERATE ON A
PORTION OF THE PAVEMENT, PRECAUTIONS MUST BE TAKEN TO
PREVENT ANY DAMAGE WHATSOEVER TO THE PAVEMENT.
7. CONDITION OF THE ,ROAD UPON COMPLETION .OF THE JOB SHALL BE AS
GOOD OR BETTER THAN PRIOR TO STARTING.
8. ALL TRENCH TO BE SHEETED SOLID AS EXCAVATED UNLESS SOILS
AND/OR ENGINEERING ANALYSIS INDICATES OTHERWISE.
9. IF ANY OF THE ABOVE CONDITIONS OR ADDITIONAL REQUIREMENTS

The State Department of Highways and Public Transportation offers no objection to the location on the right-of-
way of your proposed 8" ethe1ene line as shown by accompanying drawings and notice dated
July 2, 1993 exceptasnoted below.
Your attention is directed to governing laws, especially to Article 6674w-', Vernon's Annotated Civil Statutes of
Texas, pertaining to Control of Access. Access for servicing this installation shall be limited to access via (a) frontage
roads where provided, (b) nearby or adjacent public roads or streets, or (c) trails along or near the highway right-of-
way lines, connecting only to an intersecting road; from anyone or all of which entry may be made to the outer
portion of the highway right-of-way for normal service and maintenance operations. The Utility Owner's rights of
access to the through-traffic roadways and ramps shall be subject to the same rules and regulations as apply to the
general public except, however, if an emergency situation occurs and usual means of access for normal service
operations will not permit the immediate action required by the Utility Owner in making emergency repairs as
required for the safety and welfare of the public, the Utility Owner shall have a temporary right of access to and
from the through-traffic roadways and ramps as necessary to accomplish the required emergency repairs. provided
the State Department of Highways and Public Transportation is immediately notified by the Utility Owner when
such repairs are initiated and adequate provision is made by the Utility Owner for convenience and safety of
highway traffic.
It is expressly understood that the State Department of Highways and Public Transportation does not purport,
hereby, to grant any right, claim, title, or easement in or upon this highway; and it is further understood that the
State Department of Highways and Public Transportation may require the owner to relocate this line, subject to
provisions of governing laws, by giving thirty (30) days written notice.
All work on the highway right-of-way shall be performed in accordance with State Department of Highways and
Public Transportation instructions. The installation shall not damage any part of the highway and adequate
provisions must be made to cause minimum inconvenience to traffic and adjacent property owners, In the event the
Owner fails to comply with the requirements as set forth herein, the State may take such action as it deems
appropriate to compel.compliance. SEE ATTACliED SPECIAL PROVISIONS

SPECIAL PROVISIONS ~R PERMIT NO. 93-8961
Highway crossing shall be either bored or tunneled. Bored hole or tunnel
shall not exceed the diameter of the pipeline by more than one inch, and
shall extend the full width of the pavement and 10 feet on each side thereof.
Where encasement is not employed, additional protective measures must
include the following:
(a) Heavier wall thickness and/or higher factor of sa.fety
in design.
(b) Adequate coating and wrapping.
(c) Cathodic protection.
(d) other measures as required by Title 49, CFR, Part 192
or Part 195. Minimum length of additional protectioo
shall be the same as that required by encasement.
Traffic control in utility work zones shall conform to applicable
specifications of the Texas Manual on Uniform Traffic control
Devices for Streets and Highways, Part VI.
This approval void if installation not complete within one year from
date of approval.
This permit issued subject to a traffic control plan which will be approved
by the Area Engineer or the person named on this permit. No work within
State right of way shall begin until this approval has been granted.
It is mutually agreed and understood that the implementation and maintenance
of the traffic control plan shall be the responsibility of the grantee
and the grantee shall indemnify and save harmless the State from any
and all damage or loss that may develop due to this project.

Dear Mr. Sherrill:
I contacted your office via written correspondence on April 2, 1993
relative to the construction of the above captioned pipelines and
received the permit captioned above. I now find that in addition to
the crossings covered by the referenced permit, two additional
crossings of SH 225 will be required.
The first crossing will be 1,331 feet east of Allen-Genoa Road. At
this point both lines will be crossing the highway. They will be
installed in a bored road crossing. This crossing is shown on
drawing F-3761, attached.
The second crossing, shown on the attached drawing F-3758, will be
crossing SH 225 1,125 feet west of Miller Cut-Off Road. This is a
single line crossing (8" line only), installed in a bored road
crossing.
Please review the plats and advise this office of the criteria which
must be met in order to obtain a permit or permits for these
crossings. Should you have questions with regard to these crossings
or the plats, please contact the undersigned at the enclosed number
or Mr. Lee Allman, Division Surveyor, at 591-3771.

Specifications for Placing Utility Lines Within the
Right of Way of State-Maintained Highways
1. All excavations within the right of way and not under surfacing
shall be backfilled by tamping in 6-inch horizontal layers and/or
as directed. All surplus material shall be removed from the right
of way and the excavation finished flush with surrounding natural
ground.
2. Where sodding is disturbed by excavation or backfilling operations,
such areas shall be replaced by seeding. Slopes 4:1 or steeper
shall be replaced by block sodding. This work shall be in accord-
ance with Highway Department specifications.
3. Highway crossings under surfaced roads and surfaced crossroads
within the right of way shall be placed'by boring. Boring shall
extend from crown line to crown line. All lines carrying pressure
shall be enclosed in satisfactory casing.
4. Use of water or other fluids in connection with boring operations
will be permitted only in sufficient quantity to lubricate boring
bit and provide a smooth flow of cuttings. Jetting will not be
pennitted.
5. Pipeline material and design for high pressure lines must meet the
minimum Federal Safety Standards for Liquid and Gas Pipelines.
6. Operations on the highways shall be performed in such a manner that
operating equipment and excavated material are kept off the pavement
at all times.
7. Barricades and warning signs, and flagmen when necessary, shall be
provided by the contractor or owner. One-half the traveled portion
of the roadway mus~ be open to traffic at all times.
8. Work performed on railroad right of way is subject to the concur-
rence of the railroad company. Work performed within waterways,
such as rivers, creeks, bayous, and drainage ditches, is subject
to the concurrence of the appropriate governmental agency.
9. All manhole covers shdll be installed flush with ground level.
The roof of communications manholes shall be at least five feet
below ground level.
