ORDINANCE NO. 91S-LL AN ORDINANCE GRANTING A PERMIT UNDER SECTION 18-a-3 OF ORDINANCE NO. 915, "PIPELINE TRANSPORTATION," BEING CHAPTER 18-A OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, TEXAS, DATED NOVEMBER 25, 1975, TO CONSTRUCT AN 8-INCH PIPE LINE FOR THE TRANSPORTATION OF CARBON MONOXIDE; AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LAPORTE: section 1. The City Council of the City of La Porte has received an application dated March 9, 1994, from AIR PRODUCTS, INC. requesting a permit under section 18-A-3 of Ordinance 915, being Chapter 18-A of the Code of Ordinances of the City of La Porte, to construct and operate its 8-inch pipe line for the transportation of CARBON MONOXIDE, crossing the City of La Porte, all as shown on said application. The application of AIR PRODUCTS, INC. has been reviewed by the City's Director of Public Works, who has found that said application meets all requirements of said Ordinance No. 915, and has recommended its approval. Section 2. The City Council of the city of La Porte hereby approves the applicaton of AIR PRODUCTS, INC., dated March 9, 1994, and this Ordinance shall constitute a permit to AIR PRODUCTS, INC. to operate said pipe line within the City of La Porte, all in conformance with the requirements of said Ordinance No. 915, contingent upon its filing with the City of La Porte prior to commencement of construction, copies of its permits from the Texas Department of Heghways and Transportation; Harris County; and the Harris County Flood Control District. Any future relocation of the pipeline herein permitted, within the City, State, or County rights- of-way, shall be at the sole expense of permittee. section 3. Dear Sir: Air Products Manufacturing Corporation plans to construct an eight (8) inch pipeline from its existing plant on Strang Road to Hoechst/Celanese in Bayport. The pipeline is being constructed for the transportation of carbon monoxide. The maximum operating pressure' is to be 700 psig with a maximum product temperature of 100oF. Attached is a route map showing the location of the pipeline within the City of La Porte and the streets being crossed along with detail drawings of the planned crossing of each street. Also attached is Air Products' Draft No. 0209 in the amount of $500.00 in payment of the initial permit fee of $300.00 and the first .annual fee of $200.00 paid in advance. The pipeline is to be constructed from Air Products' Plant on Strang Road to HoechstlCelanese in Bayport. We have now been informed that the pipeline is to be owned and operated by Air Products, Incorporated instead of Air Products Manufacturing Corporation. Attached are two (2) copies of the route map and the detail drawings of the streets being crossed that have been revised to reflect the correct company name. No other changes have been made on the drawings. Please have the Ordinance prepared in the name of Air Products, Incorporated. Thank you for your assistance. Your attention is directed ,to governing laws, especially to Article 6674w-l, Vernon's Annotated Civil Statutes of Texas, pertaining to Control of Access. Access for serving this installation shall be limited to access via (a) frontage roads where provided, (b) nearby or adjacent public roads or streets, (c) trails along or near the highway right-of-way lines, connecting only to an intersecting road; from anyone or all Qf which entry may be made to the outer portion of the highway right-of-way for normal service and maintenance operations. The Owner's rights of access to the through-traffic roadways and ramps shall be subject to the same rules and regulations as apply to the general public except, however, if an emergency situation occur~ and usual means of access for normal service operations will not permit the immediate action required by the Utility Owner in making emergency repairs as required for the safety and welfare of the public, the Utility Owners shall have a temporary right of access to and from the through- traffic roadways and ramps as necessary to accomplish the required emergency repairs, provided TxDOT is immediately notified by the Utility Owner when such repairs are initiated and adequate provision is made by the Utility Owner for convenience and safety of highway traffic. Highway crossing shall be either bored or tunneled. Bored hole or tUl'Ulel shall not exceed the diameter of the pipeline by more than one inch, and shall extend the full width of the pavement and 10 feet on each side thereof. Where encasement is not employed, additional protective measures must include the following: (aJ Heavier wall thickness and/or higher factor of safety in design. (b) Adequate coating and wrapping. (c) Cathodic protection. (d) Other measures as required ,by Title 49, em, Part 192 or Part 195. Minimum length of additional protection shall be the same as that required by encasement. All excavations within the right of way and not under surfacing shall be backfilled by tamping in 6-inch horizontal layers and/or as directed. All surplus material shall be removed from the right of way and the excavation finished flush with surrounding natural ground. 2. Where sodding is disturbed by excavation or backfilling operations, such areas shall be replaced by seeding. Slopes 4:1 or steeper shall be replaced by block sodding. This work shall be in accord- ance with Highway Department specifications. 3. Highway crossings under surfaced roads and surfaced crossroads within the right of way shall be placed"by boring. Boring shall extend from crown line to crown line. All lines carrying pressure shall be enclosed in satisfactory casing. 4. Use of water or other fluids in connection with boring operations will be permitted only in sufficient quantity to lubricate boring bit and provide a smooth flow of cuttings. Jetting will not be permitted. 5. Pipeline material and design for high pressure lines must meet the minimum Federal Safety Standards for Liquid and Gas Pipelines. 6. Operations on the highways shall be performed in such a manner that operating equipment and excavated material are kept off the pavement at all times. 7. Barricades and warning signs, and flagmen when necessary, shall be provided by the contractor or owner. One-half the traveled portion of the roadway must be open to traffic at all times. 8. Work performed on railroad right of way is subject to the concur- rence of the railroad company. Work performed within waterways, such as rivers, creeks, bayous, and drainage ditches, is subject to the concurrence of the appropriate governmental agency. 9. All manhole covers sh~ll be installed flush with ground level. The roof of commW1ications manholes shall be at least fi.ve feet below groW1d level. e . 10. No raw sewage or effluence from septic tanks~ car wash, or sUnilar facilities shall be drained into State Highway storm sewer systems. 11. Power transmission line crossings over highways shall be constructed and maintained a mintmum of 22 feet above the surface of the traffic lanes. For power lines above 50,000 volts, the clearance shall be increased in accordance with the National Electric Safety Code as published in the National Bureau of Standards, Handbook 30. 12. Communications line crossings over highways shall be constructed and maintained a mintmum of 18 feet above the surface of the traffic lanes. 13. Work covered by this permit shall be so conducted that it will not interfere in any way with any highway contract construction or repair work, or any State maintenance work that may be done on this road. In the event such interference occurs, you will cease opera- tions in the area until such ttme as the road work referred to above is completed. HARRIS COUNTY FLOOD CONTROL DISTRICT STANDARD NOTES FOR PIPELINE/UTILITY CROSSINGS The Harris County F~ood Control District, Department, shall be notified at least 48 hours construction (713-684-4042). A copy of the construction drawings is required at this time. 2. At completion of construction, the pipeline owner shall submit letter and record drawings to the Harris County Flood Control District, Utility Department, requesting inspection of items constructed in Harris County Flood Control District right-of-way. Utility prior to approved 1. 3. The pipeline owner or his contractor shall be responsible for protecting, maintaining, and restoring backslope drainage systems. 4. Backfill is to be compacted in no greater than 1-foot lifts to the density of the undisturbed adjacent soil. 5. The pipeline owner or his contractor shall be responsible for maintaining flow in the channel during construction and restoring the channel to its original condition. 6. All excess excavated material is to be removed from the Harris County Flood Control District right-of-way.
