AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED
FOR VEHICLES UNDER THE PROVISIONS OF ARTICLE 670lD, VERNON'S
TEXAS CIVIL STATUTES, UPON THE BASIS OF AN ENGINEERING AND
TRAFFIC INVESTIGATION, UPON CERTAIN STREETS AND HIGHWAYS, OR
PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF
LA PORTE, AS SET OUT IN THIS ORDINANCE; PROVIDING A PENALTY
OF A FINE NOT TO EXCEED TWO HUNDRED DOLLARS ($200.00) FOR THE
VIOLATION OF THIS ORDINANCE; AND PROVIDING AN EFFECTIVE DATE
HEREOF.
WHEREAS, Article 670lD, Vernon's Texas Civil Statutes,
provides that whenever the governing body of the City shall
determine upon the basis of an engineering and traffic investi-
gation that any prima facie speed therein set forth is greater
or less than is reasonable or safe under the conditions found
to exist at any intersection or other place or upon any part
of a street or highway within the City, taking into considera-
tion the width and condition of the pavement and other circum-
stance on such portion of said street or highway, as well as
the usual traffic thereon, said governing body may determine
and declare a reasonable and safe prima facie speed limit
thereat or thereon by the passage of an ordinance, which shall
be effective when appropriate signs giving notice thereof are
erected at such intersection or other place or part of the
street or highway, now therefore,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE:
Section 1. Upon the basis of an engineering and traffic
investigation heretofore made as authorized by the provisions
of Article 670lD, Vernon's Texas Civil Statutes, the following
prima facie speed limits hereafter indicated for vehicles are
h&reby determined and declared to be reasonable and safe; and
such speed limits are hereby fixed at the rate of speed indi-
cated for vehicles traveling upon the named streets and highways,
or parts thereof, described as follows:
(a) Along SH 146 (Main Lanes) from the north city
limit to the south city limit, a distance of
approximately 2.712 miles, 60 MPH;
(b) Along SH 146 (West Frontage Road) from Fairlane
to a point 317 feet south of Spencer, a distance
of approximately 0.800 mile, 40 MPH;

(c) Along SH 146 (West Frontage Road) from 317 feet
south of Spencer to a point 2967 feet south of
West B Street, a distance of approximately 0.687
mile, 50 MPH;
(d) Along SH l46 (East Frontage Road) from Crestlane
to Tyler, a distance of approximately 0.280, 35 MPH;
(e) Along SH 146 (East Frontage Road) from W. Polk to
a point 380 feet south of West B Street, a distance
of approximately 0.345 mile, 40 MPH;
(f) Along SH 146 (East Frontage Road) from a point 380
feet south of West B Street to a point 845 feet
south of West G Street, a distance of approximately
0.489 mile, 50 MPH.
Section 2. Any person violating any of the provisions
of this ordinance shall be deemed guilty of a misdemeanor and
upon conviction thereof shall be fined in any sum not more
than Two Hundred Dollars ($200.00).
Section 3. This Ordinance shall be effective fourteen
(14) days after its passage and approval. The City Clerk shall
give notice of the passage of this ordinance by causing the
caption hereof to be published in the official newspaper in
the City of La Porte at least twice within ten (10) days after
the passage of this ordinance.
