HomeMy WebLinkAboutO-1972-940 &.' .. . . . e ORDINANCE NO. 940 AN ORDINANCE AMENDING CHAPTER 17 OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE; REGULATING THE PRACTICE OF GOING IN AND UPON PRIVATE RESIDENCES IN THE CITY OF LA PORTE, TEXAS, BY VENDORS, WITHOUT THE INVITATION OF THE OWNER OR OCCUPANT; DECLARING THE SAME TO BE A NUISANCE; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00); CONTAINING A REPEALING CLAUSE; AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: Section 1. The Code of Ordinances of the City of La Porte is hereby arnended by repealing Chapter 17, Section 17-1 through 17-21, both inclusive, thereof, and substituting therefor the fOllowing, to-wit: "Section 17-1. Uninvited peddling at private residences declared a nuisance. "The practice of going in and upon private residences, including rnulti-farnily dwellings, in the City of La Porte, Texas, by solicitors, peddlers, hawkers, itinerant rnerchants, or transient vendors of any goods, wares, merchandise, serv- ices, photographs, rnagazines or subscriptions to rnagazines, not having been requested or invited so to do by the owner or owners, occupant or occupants of said private residences for the purpose of SOliciting orders for the sale of any goods, wares, rnerchandise, services, photographs, rnagazines or sub- scriptions to rnagazines, and disposing of, peddling or hawking the sarne, is hereby declared to be a nuisance and punishable as such nuisance as a rnisderneanor. "Section 17-2. Sarne--Nuisance ordered abated. "The Chief of Police and police officers of the City of La Porte, Texas, are hereby required and directed to suppress the sarne and to abate any such nuisance as is described in Section 17-1 hereof." Section 2. Any person who shall violate any provision of this ordinance shall be deerned guilty of a rnisderneanor and upon conviction shall be punished by a fine not to exceed Two Hundred Dollars ($200.00). Section 3. This Ordinance shall be effective fourteen (14) days after its passage and approval. The City Clerk shall give notice of the passage of this ordinance by causing the caption hereof to be published in the official newspaper in the City of La Porte at least twice within ten (10) days after the passage of this ordinance. .. 0" '- .
