AN ORDINANCE VACATING, ABANDONING AND CLOSING THE PORTION OF
SOUTH NINTH (9TH) STREET LYING WITHIN THE AREA BOUNDED BY THE
SOUTH RIGHT""'OF-WAY LINE OF WEST "F" STREET, AND THE NORTH RIGHT-
OF-WAY LINE OF WEST "G" STREET, AND BETWEEN BLOCK ONE HUNDRED
FORTY-ONE (141) AND ONE HUNDRED FORTY-TlI'JO (142) IN THE TOWN OF'
LA PORTE, HARRIS COUNTY, TEXAS; AND ALSO VACATING, ABANDONING
AND CLOSING THE PORTION OF SOUTH NINTH (9TH) STREET LYING WITHIN
THE AREA BOUNDED BY THE SOUTH RIGHT-OF-WAY LINE OF WEST "G"
STREET, AND THE NORTH RIGHT-OF-WAY LINE OF WEST "H" STREET, AND
BETWEEN BLOCK ONE HUNDRED FORTY-SEVEN (147) AND BLOCK ONE
HUNDRED FORTY-EIGHT (148) IN THE TOWN OF LA PORTE, HARRIS
COUNTY, TEXAS; AND ALSO VACATING, ABANDONING AND CLOSING THE
ALLEY LYING WITHIN BLOCK ONE HUNDRED FORTY-ONE (141) OF THE
TOWN OF LA PORTE, HARRIS COUNTY, TEXAS; AND PROVIDING AN
EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE:
WHEREAS, the City Commission of the City of La Porte has
been requested by the record owner of all of the property
abutting South Ninth (9th) Street between the South right-of-
way line of West "F" Street, and the North right-of-way line of
West "G" Street, and between the South right-of-way line of
West "G" Street and the North right-of-way line of West "H"
Street, to vacate, abandon and permanently close those portions
of South Ninth (9th) Street; and
WHEREAS, said portions of South Ninth (9th) Street have
never been opened or used as public roads or streets; and
WHEREAS, said portions of South Ninth (9th) Street are
less than one block East of and parallel to new State Highway
146, which is a main traffic artery and thoroughfare in the
City of La Porte, and the said New State Highway 146 will in
the future continue to furnish all needed access and thorough-
fare for traffic of any nature in said area; and
WHEREAS, the City Commission of the City of La Porte has
determined and does hereby find, determine and declare that
the hereinafter described portions of South Ninth (9th) Street
are not suitable, needed, or beneficial to the public as public
roads or streets, and that the closing of the hereinafter
described portions of South Ninth (9th) Street are for the
protection of the public, and for the public benefit, and that
such portions of South Ninth (9th) Street should be vacated,

abandoned, and permanently closed; and
WHEREAS, the said alley in said Block One Hundred Forty-one
(141), Town of La Porte, Harris County, Texas, has never been
opened or used as a public thoroughfare; and
WHEREAS, each of the public utilities now holding a fran-
chise from the City of La Porte, together with the Water and
Sewer Department of the City of La Porte, have each and all
given their written consent for the closing of said portions of
South Ninth (9th) Street, and for the closing of said alley in
Block One Hundred Forty-one (141), Town of La Porte; and
WHEREAS, the City Commission of the City of La Porte has
determined and does hereby find, determine and declare that
said portions of said South Ninth (9th) Street, and said alley
are not suitable, needed, or beneficial to the public as public
streets and public alleys, and should be vacated, abandoned, and
permanently closed:
Section 1. Under and by virtue of the power 'granted to
the City of La Porte under its Home Rule Charter and Chapter 13,
Title 28, Article 1175, of the Revised Civil Statutes of the
State of Texas, 1925, all of that portion of South Ninth (9th)
Street, lying and being situated between the South right-of-way
line of West "F" Street, and the North right-of-way line of
West "G" Street, and between Block One Hundred Forty-one (141)
and Block One Hundred Forty-two (142), in the Town of La Porte,
Harris County, Texas; and all of that portion of South Ninth (9th)
Street, lying and being situated between the South right-of-way
line of West "G" Street, and the North right-of-way line of
~\7est "H" Street, and between Block One Hundred Forty-seven (147)
and Block One Hundred Forty-eight (148), in the Town of La Porte,
Harris County, Texas; and the alley lying and being situated
within Block One Hundred Forty-one (141), Town of La Porte,
Harris County, Texas, according to the map or plat thereof
recorded in the office of the County Clerk of Harris County,
Texas, are hereby permanently vacated, abandoned, and closed by

the City of La Porte.
Section 2. This Ordinance shall not be effective until
such time. as the City of La Porte issues a building permit for
construction of a commercial building on either Block One
Hundred Forty-one (141), or the residue of Block One Hundred
Forty-two (142), or the residue of Block One Hundred Forty-seven
(147), or on Lots One (1) through Twenty (20) and Twenty-eight
(28) thro~gh Thirty-two (32), Block One Hundred Forty-eight (148),
all in the Town of La Porte, Harris County, Texas, or any
combination or combinations of said properties. If such building
permit has not been issued within one year from the date of the
passage of this Ordinance, this Ordinance shall be void and of
no further effect.
