ORDINANCE NO. 2015 A(
AN ORDINANCE ESTABLISHING THE MEMBERSHIP STRUCTURE OF THE
CITY OF LA PORTE FISCAL AFFAIRS COMMITTEE, AND APPOINTNG
MEMBERS TO SUCH COMMITTEE; CONTAINING A REPEALING CLAUSE;
CONTAINING A SEVERABILITY CLAUSE; FINDING COMPLIANCE WITH THE
OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, the La Porte City Council previously created the Audit Committee, which has
since been renamed the City of La Porte Fiscal Affairs Committee ("Fiscal Affairs Committee"
herein); and
WHEREAS, the La Porte City Council desires to restructure the composition of the Fiscal
Affairs Committee, which currently consists of three (3) regular members, being Chuck Engelken,
Daryl Leonard and one e vacanc ; and, two 2 alternate members being Jay Martin Alt. #1 and
Y O 9 Y ( )
Dottie Kaminski (Alt. #2), in as much as the presence of all three regular members and the two
alternates at a meeting of the Fiscal Affairs Committee constitutes a quorum of councilmembers
gathered to discuss City business; and
WHEREAS, the City Council determines that it would be desirable for the total number
of regular members plus the alternate members of the Fiscal Affairs Committee to equal less
than a quorum of councilmembers.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council hereby establishes that the Fiscal Affairs Committee shall be
comprised of three (3) regular members, and one (1) alternative member. Such alternate may
attend all meetings and will serve as a voting member in the event a regular member of the Fiscal
Affairs Committee is unable to attend a meeting.
Section 2. To be eligible for appointment to the Fiscal Affairs Committee as a regular or
alternate member, a person must also be a member of the La Porte City Council.
Section 3 All ordinances or parts of ordinances inconsistent with the terms of this
ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent
of such inconsistency and in all other respects this ordinance shall be cumulative of other'
ordinances regulating and governing the subject matter covered by this ordinance.
Section 4. If any section, sentence, phrase, clause, or any part of any section, sentence,
phrase, or clause, of this Ordinance shall, for any reason, be held invalid, such invalidity shall not
affect the remaining portions of this Ordinance, and it is hereby declared to be the intention of this
City Council to have passed each section, sentence, phrase, or clause, or part thereof, irrespective
of the fact that any other section, sentence, phrase, or clause, or part thereof, may be declared
invalid.
Section S. The City Council officially finds, determines, recites, and declares that a
sufficient written notice of the date, hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the City for the time required by law
preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government
Code; and that this meeting has been open to the public as required by law at all times during
which this ordinance and the subject matter thereof has been discussed, considered and formally
acted upon. The City Council further ratifies, approves and confirms such written notice and the
contents and posting thereof.
Section 6. This Ordinance shall be in effect from and after its passage and approval.
