KNOW ALL MEN BY THESE PRESENTS
COUNTY OF HARRIS
That BAYWAY HOMES, INC. ("Grantor"), for and in consideration to Ten and no/100 Dollars
($10.00) and other good and valuable consideration paid by the CITY OF LA PORTE
("Grantee"), a Municipal Corporation, the receipt and sufficiency of which is hereby
acknowledged and confessed, have this day GRANTED, BARGAINED, SOLD AND
CONVEYED and by these presents do GRANT, SELL AND CONVEY unto said GRANTEE, and
to its successors and assigns the perpetual right, privilege and easement, with appropriate
rights of ingress and reasonable working area for construction and maintenance, to enter upon
and construct, reconstruct, maintain, operate, inspect, replace, repair and remove A 15"
SANITARY SEWER LINE together with all necessary appurtenances, over, across, through and
under that certain tract or parcel of,land lying and being situated in Harris County, Texas and
being more particularly described on Exhibits "A" & "B" attached hereto and made a part hereof
for all purposes.
TO HAVE AND TO HOLD the above described easement, together with all and singular the
rights and appurtenances thereto in anywise belonging unto said GRANTEE, and its successors
or assigns, in accordance with the terms and conditions hereinabove set forth. The GRANTOR
does hereby bind itself, its successors or assigns to WARRANT AND FOREVER DEFEND, all
and singular the said easement unto the GRANTEE, its successors or assigns, against every
person whomsoever lawfully claiming or to claim the same or any part thereof.

10' WIDE UTILITY EASEMENT
OUT OF SYLVAN AVENUE
BEING a 0.0689 acre tract (3,000 Sq. Ft.) of land out of and a part of the unopened portion of Sylvan
Avenue (80' R.O.W.) and being 20.00' north of the northeast line of Block 14, of Sylvan Beach, First
Addition, a subdivision in Harris County, Texas, according to the map or plat thereof recorded in Volume 3,
Page 72, of the Map Records of Harris County, Texas, said 0.0689 acre tract being more particularly
described by metes and bounds as follows:
COMMENCING at the most northerly west corner of Lot 1 of said Block 14, and being in the southeast right
of way line of Willow Avenue (60' R.O.W.);
THENCE N23009'58"E along the southeast right of way line of said Willow Avenue, a distance of 35.00' to
the POINT OF BEGINNING of the tract herein described;
THENCE continuing N23°09'58"E along the southeast right of way line of said Willow Avenue, a distance of
10.00' to a point for the most northerly corner of the tract herein described;
THENCE S66050'02"E parallel to the northeast line of said Block 14, a distance of 300.00' to a point for the
most easterly corner of the tract herein described, and being in the northwest right of way line of Park
Drive (70' R.O.W.);
THENCE S23009'58"W along the northwest right of way line of said Park Drive, a distance of 10.00' to a
point for the most southerly corner of the tract herein described;
THENCE N66050'02"W parallel to the northeast line of said Block 14, a distance of 300.00' to the POINT OF
