ORDINANCE NO. 1028
.
AN ORDINANCE CALLING THE REGULAR ANNUAL ELECTION OF THE CITY
OF LA PORTE; CALLING A RUN-OFF ELECTION, IF NECESSARY; DESIG-
NATING AN ELECTION PRECINCT AND A POLLING PLACE; PROVIDING
FOR THE USE OF VOTING MACHINES; APPOINTING ELECTION OFFICIALS;
PROVIDING FOR METHOD AND DATES OF ABSENTEE VOTING; PROVIDING
FOR RETURN AND CANVASS OF VOTES OF SAID ELECTION; PROVIDING
FOR NOTICE; PROVIDING FOR FILING DEADLINE AND FILING PROCEDURES
FOR CANDIDATES; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN
EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE:
Section 1. An election shall be held within the corporate
limits of the City of La Porte, Texas, on the 3rd day of April,
1976, such day being the first Saturday in April, 1976,
between seven o',clock (7:00) A.M. and seven o'clock (7:00) P.M.,

for the purpose of electing a Mayor of said City; a Commissioner
of said City for Position No.2; and a Commissioner of said
City for Position No.4. A run-off election, if necessary,
shall be held on April 24, 1976, betw~en the same hours.
Section 2. The City Commission of the City of La Porte
hereby designates and establishes all. of the area encompassed
within the corporate limits of the City of La Porte, as one
election precinct for this election, and the La Porte Civic
Center, 618 San Jacinto Street, La Porte, Texas, is designated
as the one polling place for such election. Voting machines
shall be used in the conduct of such election.

Section 3.
Mrs. Arbela Ralston
is hereby
appointed Presiding Judge of said election, and
Mrs. Lorraine Miller is hereby appointed Alternate Presiding
Judge of said election. The maximum number of clerks which
may be appointed to serve at said election is three (3), who
shall be selected by the Presiding Judge or the Alternate
Presiding Judge, as the case may be.
Section 4. Absentee voting by personal appearance shall
begin on the 20th day and shall continue through the 4th day
preceding the day of the election. Absentee voting shall be
conducted by the City Clerk at the City Hall, 124 S. 2nd Street,

La Porte, Texas. Voting machines shall be used for the casting

of absentee votes at such election. The City Clerk shall not
permit anyone to vote absentee by personal appearance on any
day which is not a regular working day for the Clerk's office,
or at any time when the Clerk's office is not open to the
public. The City Clerk of the City of La Porte is hereby
authorized and directed to appoint deputy absentee balloting
clerks, as necessary.
Section 5. Immediately after the close of the polls on
the 3rd day of April, 1976, the election officials shall make
due return thereof to the City Commission of the City of
La Porte, and the City Commission shall canvass said returns

at the earliest practicable time, and shall, immediately after
canvassing the returns, declare the results of the election.
The Mayor shall immediately thereafter deliver to the candi-
date for whom the majority of votes has been polled for each
respective office, a certificate of election. Such elected
officials shall assume their duties within ten (10) days
thereafter, Sundays excluded, upon their taking the oath of
office.
Section 6. Notice of said election shall be given by
publication in the La Porte-Bayshore Sun, not less than ten

(10) days nor more than thirty (30) days prior to the date
of the said election, of the following notice:
"NOTICE OF ELECTION
"I, . I. J. KIBODEAUX, .Mayor Pro-Tern of the City of
La Porte, Texas, by virtue of the power vested in me
by law, do hereby order that an election be held in
the City of La Porte, Texas, on the 3rd day of April,
1976, and a run-off election, if necessary, shall be
held on April 24; 1976, for the purpose of electing
a Mayor; a Commi$sioner for Position 2; and a
Commissioner for Position 4; and that said election
shall be held at the La Porte Civic Center,
618 San Jacinto Street, La Porte, Texas, between
seven o'clock (7:00) A.M. and seven o'clock (7:00) P.M.
on said date, and the following named persons are the
appointed officials of said election, to-wit:
"Presiding Judge
Mrs. Arbela Ralston

"Alternate Presiding Judge Mrs. Lorraine Miller

"Absentee voting by personal appearance shall begin
on the 20th day and shall continue through the 4th
day preceding the day of the election and shall be
conducted at the City Hall of the City of La Porte,
between the hour~ of nine o'clock (9:00) ~.M. and
five o'clock (5:00) P.M., Mondays through Fridays,
and on Saturdays from ten o'clock (10:00) A.M. until
two o'clock (2:00) P.M., except on legal holidays.

and further notice of said election shall be given by posting
a copy of this Ordinance at the City Hall for thirty (30)
days next preceding said election.
Section 7. The City Clerk is hereby authorized and
directed to give notice of said election in accordance with
.
Section 6 hereof.
Section 8. Upon a candidate tendering his application
on the form prescribed, the City Clerk shall furnish to such
candidate all information relative to the qualifications for
the office being. sought, and the methods of placing the
candidate's name on the ballot.
Section 9. The deadline for a candidate to make applica-
tion to have his name appear upon the ballot for such election,
is hereby designated and established as five o'clock (5:00)
P.M., Wednesday, March 3, 1976. The filing fee for each

candidate for the office of Commissioner is hereby established
at Fifty Dollars ($50.00), and the filing fee for Mayor is
hereby established at the sum of One Hundred Dollars ($100.00).
The filing fees shall be used to defray the cost of the elec-
tion, and said fees shall be prorated and any surplus shall be
refunded to the candidates paying filing fees. As an alterna-
tive to paying a filing fee, a candadate may obtain a place
on the ballot by filing a petition as provided for in City
of La Porte Ordinance No. 968, passed and approved October 1,
1973, codified as Section 9-3 of the Code of Ordinances of
the City of La Porte.

Section 10. Said election shall be held in accordance
with the provisions of the City Charter of the City of
La Porte, and the general election laws of the State of
Texas governing genreal and municipal elections, so far as
same may be applicable thereto.
Section 11. Each and every provision, paragraph,
sentence and clause of this Ordinance has been separately
considered and passed 'by the City Commission of the City of
La Porte, Texas, and each said provision would have been
separately passed without any other provision, and if any
provision hereof shall be ineffective, invalid or unconsti-
tutional, for any cause, it shall not impair or affect the
remaining portion, or any part thereof, but the valid portion
shall be in force just as if it had been passed alone.
Section 12. This ordinance shall be in effect immediately
upon its passage and approval.
