AN ORDINANCE OF ,THE CITY OF LA PORTE, ADOPTING AND APPROVING
THE RATE SCHEDULES TO' BE KNOWN AS RS-l, MGS-l, MSL, AND
RIDERS FC AND COS, AS SET FORTH IN EXHIBITS "A" THROUGH "E",
BOTH INCLUSIVE, A~ ATTACHED HERETO AND MADE A PART HEREOF BY
REFERENCE; AND PROVIDING FOR AN EFFECTIVE DATE FOR SUCH RATES.
BE IT ORDAINED BY THE:CITY COMMISSION OF THE CITY OF LA PORTE:
Section. 1. The City Commission of the City of La Porte,
Texas, hereby approves and adopts as maximum charges to resi-
dential and small commercial users. for electricity and electric
service the rate schedules of Houston Lighting & Power Company,
a public utility doing business under franchise in the City of
La Porte; Texas, which schedules shall be known as Schedules
RS-l, MGS-l, and MSL, and Riders FC and COS, said schedules
e and riders being attached hereto and marked Exhibit "A"
through Exhibit "E", both .inclusive, and made a part hereof
by reference as if ful~y copied herein.
Section 2. The rates and charges prescribed in this
Ordinance shall apply ~o all the electricity used by each
customer to whom such rates are applicable as provided herein
from and after each such customer's first regular meter
reading following' the adoption of this Ordinance.

Rate Schedule RS-1
RESIDENTIAL SERVICE
AREA I
AVAILABILITY - At all points where facilities of adequate capacity and the required phase
and suitable voltage are adjacent to the premises to be served. Where the service desired by
the customer is uot adjacent to the premises to be served, additional contract arrangements
may be required prior to service being furnished.
APPLICATION - To all Electric Service required for residential purposes in individual pri-
vate dwellings and in individually metered apartments when such service is supplied at
one Point of Delivery and measured through one Meter.
Where two family or housekeeping units are served through one meter, it will be op-
tional with the Customer whether the kilowatt-hour steps in the rate and the minimum bill
provisions will be doubled for billing purposes or whether all the service will be furnished
under the General Service Schedule. Where more than two family units or apartments are
served through one Meter, billing will be under the applicable General Service Schedule.
Where a portion of such Electric Service is used for non-residential purposes the appro-
priate General Service Schedule is applicable to all the Electric Service supplied. However,
if the Customer's wiring is so arranged that the Electric Service .for residential purposes
and for non-residential purposes can be metered separately, this Schedule is applicable to the
portion used for residential purposes. . .
Not applicable to temporary, breakdown, standby, supplementary or resale service.
TYPE OF SERVICE - Single phase, 60 cycles, 120/240 volts alternating current.
NET MONmLY BILL
Ra.te - Billing Months of November thru April
$2.10 which includes the use of 20 kwh
3.90(: per kwh for the next 90 kwh
2.90(: per kwh for the next 190 kwh
2.40C per kwh for the next 300 kwh
1.80<: per kwh for all additional kwh.
Billing Months of May thru October
$2.10 which includes the use of 20 kwh;
3.90(: per kwh for the next 90 kwh;
2.90~ per kwh for the next 190 kwh;
2.40(: per kwh for all additional kwh.
Minimum - $2.10
Adjustments - First: Plus or minus an amount for changes in fuel cost calculated in accord-
ance with Rider FC.
Second: Plus or minus an amount for changes in cost of service in accordance
with Rider COSo
PAYMENT - Net bills are due when rendered ar.d are payable within 10 days thereafter. Bills
not so paid shall be the net bill as ren~ered plus 10% of the first $50.00.
CONTRACT PERIOD - Open order,. and subject to the Company's Terms and Conditions for
the Sale of Electric Service.

MISCELLANEOUS GENERAL SERVICE
AREA I

A V AILABILITY - At all points for loads of 50 Kva or less where facilities of adequate c~pacity
and the required phase and suitable voltage are adjacent to the premises to be served. For loads
in excess of 50 Kva Rate Schedule MGS-l L shall apply. For loads where the service desired by the
customer is not adjacent to the premises to be served additional contract arrangements may be
required prior to service being furnished. Not available for temporary, breakdown, standby,
supplementary or resale service.
APPLICATION - To any customer for all' Electric Service supplied at one premises through one
Point of Delivery and measured through one Meter.
TYPE OF SERVICE - Single or three phase, 60 cycles and at anyone of the Company's
standard service voltages as described in the Company's Service Standards.

NET MONTHLY BILL -
Rate - $2.30 including the use of 20 kwh:
5.30~ per kwh for the next 80 kwh;
3.57~ per kwh for the next 700 kwh (subject to adjustment stated below):
3.20~ per kwh for the next 2300 kwh;
1.51 ~ per kwh for all additional kwh.
Adjustment The above rate is applicable to loads oflOkva or less and when in excess thereof
Plus - the kwh to be charged for at the above stated 3.57~ step of the rate will be
increased by 100 kwh per kva over 10 kva.
Minimum - If upon expiration of any 24 consecutive monthly billings, subsequent to the
date service is first supplied under this rate schedule, customer's total paym~nts
are not equal to or more than $12.00 per kva for each kva in excess oflO kV;t of
the maximum kva supplied during such period Company may remove its
facilities unless the customer agrees to pay a minimum billing equivalent to
S 12.00 per kva for each kva in excess oflOkva of the maximum kva required to
satisfy customer's service requirements for the next 24 consecutive monthly'
billings or any fraction thereof.
Adjustmellts - First: Plus or minus an amount for changes in fuel cost calculated in accordance
with Rider Fe.
Second: Plus or minus an amount for changes in cost of service in accordance
with Rider COSo

DETERMINATION OF KVA - The KVA (kilovolt amperes) applicable to the Net Monthly Bill
shall be as follows:
(A) For the billing months of May through October the Kva shall be the average Kva
supplied during' the 15 minute period of maximum use during the month then. being billed,
as determined from meter readings. The K va may be determined by the use of a standard
block interval integrated Kva meter or thermal ammeter calibrated to read Kva based on the
Company's standard voltage supplied.
(B) For the billing months of November through April the metered Kva will be
determined as outlined above ~nd the billing Kva will be determined as follows:
(I) If the metered Kva is less than the Kva used for billing the preceding August
(hereinafter called August K va) then the metered K va will be the K va used for billing.

MUNICIPAL STREET LIGHTING SERVICE
e AVAILABILITY - At all points within the corporate limits of any City, which has granted the
Company a standard 50-year franchise, where facilities of adequate capacity and suitable voltage
are adjacent to the lamps to be served.
APPLICATION - To the requirements of the City upon approved orders issued to the Company
by the City, giving number, type and lumen rating of lamps to be installed. Installation, main-
tenance and operation of street lights will be at the expense of the Company.

(I) For Mercury Vapor Lamps Mounted on Ornamental
Standards Served by Underground Conductors
(a) 60,000 lumen lamps with one lamp per standard.
(b) 20,000 lumen lamps with one lamp per standard.
(c) 20,000 lumen lamps with two lamps per standard
(d) 7,500 lumen lamps with one lamp per standard.
(e) 3,300 lumen lamps with one lamp per standard.
(2) For Mercury Vapor Lamps M9unted on Ornamental
Standards Served By Overhead Cond1;Jctors
(a) 60,000 lumen lamps with one lamp per standard.
(b) 20,000 lumen lamps with ()ne lamp per standard.
(c) 20,000 lumen lamps with two lamps per standard
(3) For Mercury Vapor Lamps Mounted on' Existing Wooden
Poles Served by Overhead Conductors
(a) 60,000 lumen lamps with one or more lamps per pole.
(b) 20,000 lumen lamps with one or more lamps per pole.
(c) 7,500 lumen lamps with one or more lamps per pole.
(d) 3,300 lumen lamps with one or more lamps per pole.
(4) For Incandescent Lamps in Service Prior tolune 2,1965
Incandescent street lighting fixtures in service as of June 2, 1965, will be continued in
service, until replaced, on the rates in effect on June 2, 1965. Additional incandescent
street lighting will not be installed after June 2, 1965.

Adjustment - Plus or minus the proportionate part of the increase or decrease in operating
expense caused by any new tax, or the revision or abolition of any existing tax, or
increased or decreased rate of tax or governmental imposition, properly charge-
able as an operating expense and based upon dollar or kwh volume of business
done [except (a) ad valorem taxes assessed or levied by any state, county, city or
special district, and (b) income taxes], levied or assessed against the company, or
upon such electric business, as the result of any new or amended laws or ordi-
nances enacted, or the repeal of any such law or ordinance, after June 1, 1959.

Billing -
Bills will be rendered month~y for one-twelfth the annual charge applicable.
This street lighting rate shall be available to railroads for the illumination of public street
crossings within the city where the lamps are installed and operated in compliance with an order
of the city.

FUEL COST ADJUSTMENT

Electric Service billed under all applicable rate schedules shall be subject to a Fuel Cost
Adjustment for changes in fuel cost. Monthly billing shall be adjusted upward or downward
by an amount per kwh to be calculated according to the following formula:

DEFINITIONS
F = Fuel Costs estimated to be incurred by the Company for the current month
and shall be composed of those costs as recorded in F.P.C. Accounts ~O1.
547 and 555 less the cost of fossil fuel recovered through intersystem sales.
S = All kilowatthours estimated to be sold and recorded in the current month
by the Company, excluding intersystem sales.

T = Estimated composite tax rate for gross receipts and other revenue related
taxes and gross receipts payments for the Company expressed as decimal.
CF = A Correction Fracto!' adjustment to be applied in the current month to
provide for an allowance due to variance between actual and estimated
fuel adjustment revenues derived from the Fuel Adjustment Factor for
the third preceding month prior to the current month. The calculation of
the Correction Factor is as follows-CF = [(A) - (B)J X (1 - T) where
(A) is the actual fuel adjustment revenues received from the Fuel Adjust-
ment Factor applied in the third preceding month and (B) is the fuel ad-
justment revenues which would have been received from application of
the Fuel Adjustment Factor in the third preceding month if actual rather
than estimated fuel cost and kilowatthour sales (described above) had
been available to calculate the Fuel Adjustment Factor for that month.
LF = Loss factors to recognize differences in losses due to voltage levels of
service. Such loss factors are as follows:

Penalty Clause
.. If at the end of December 31, 1976, and on an annual basis thereafter, the net sum of the
Correction Factors for the previous 12 months exceeds 5% of the sum of "(B)" above for the
same period, then a penalty equal in amount to 10% of such excess will be computed and this
amount will be used to reduce the F'uel Adjustment Factor in the next succeeding March. This
reduction will not otherwise affect such computation of the Fuel Adjustment Factor for sub-
sequent periods.

COST OF SERVICE ADJUSTMENT
Electric Service billed under all applicable rate schedules shall be subject to a Cost of
Service Adjustment for changes in costs as defined below. Monthly billing for the cUlTent
month shall be adjusted upward or downward by an amount per kwh to be calculated accord-
ing to the following formula:

preciation and (3) revenue requirements of seeuriti'es with stated fixed
costs for 12 months ending with second preceding month.

R = Sum of electric operating revenues exclusive of cost of service revenues
