AN ORDINANeE DEeLARING THE POLICY OF THE CITY OF LA PORTE eONeERNING A PORTION OF THE ALLEY IN BLoeK 44, BAYFRONT ADDITION TO THE TOWN OF LA PORTE; AND PROVIDING AN EFFEe- TlVE DATE HEREOF. BE IT ORDAINED BY THE CITY COMMISSION OF THE eITY OF LA PORTE: Section 1. The eity eommission of the eity of La Porte hereby finds, determines, and declares, that the hereinafter described portion of the alley in Block Forty-four (44), Bayfront Addition to the Town of La Porte, is not now, and has never been, open to through pedestrian and vehicular traffic, to-wit: . Being a portion of the 16 foot alley in Block 44, Bayfront Addition to the Town of La Porte as recorded by plat in Volume 1 at Page 53 of the Harris eounty Map Records, out of the Johnson Hunter Survey, A-35, La Porte, Harris eounty, Texas, said portion of said alley being bound on the East by Lots 15 thru 20, both inclusive; on the West by Lots 9 thru 14, both inclusive; on the South by the North right-of-way line of East "D" Street and on the North by the North lines of Lots 9 and 20 extended across said alley; said portion of said alley being more particularly described as follows: BEGINNING at the Southeast corner of Lot 14, Block 44, Bayfront Addition, as recorded; Thence, N 270 IS' W, along the East line of Lots 14, 13, 12, 11, 10, and 9, a distance of 150 feet to the Northeast corner of said Lot 9; Thence N 620 45' E, across said alley, a dis- tance of 16 feet to the Northwest corner of Lot 20; . Thence S 270 IS' E, along the West lines of Lots 20, 19, 18, 17, 16, and 15, a distance of 150 feet to the Southwest corner of said Lot 15; Thence S620 45' W, across said alley, a dis- tance of 16 feet to the POINT OF BEGINNING. Section '2. The City Commission of the City of La Porte hereby finds, determines, and declares, that there is no public need or necessity for the opening of the hereinabove described portion of the alley in Block Forty-four (44), Bayfront Addition to the Town of La Porte, to vehicular and pedestrian traffic, and it is Ordered that the same shall not hereafter be open to through pedestrian and vehicular ..-_:~ , ' , traffic. .' .' Nothing in this Ordinance shall be construed as limiting or abridging the easement rights of the eity of La Porte, and those public utilities holding franchises with the eity of La Port~, to make full use of the hereinabove described portion of the alley in Block Forty-four (44), Bayfront Addition to the Town of 'La Porte, for utility ease- ment purposes, together with any necessary pedestrian and vehicular traffic in relation thereto.
