ORDINANCE NO. 1057
AN ORDINANCE AMENDING ORDINANCE NO, 1052 AND AUTHORIZING AND
DIRECTING THE MAYOR AND THE CITY CLERK OF THE CITY OF LAPORTE
e FOR AND ON BEHALF OF THE CITY OF LAPORTE TO EXECUTE AND TO AFFIX
THE SEAL OF THE CITY TO A MODIFICA TION OF THE EXISTING AGREEMENT OF
LEASE BETWEEN THE CITY, AS LESSOR AND GREGORY AVIATION, AS LESSEE,
PROVIDING THEREIN THAT THE TERM OF THE LEASE SHALL BEGIN ON THE
23RD DAY OF NOVEMBER 1976 AND END ON THE 31ST DAY OF DECEMBER 1996;
ACCORDING TO THE TERMS, PROVISIONS, AND CONDITIONS CONTAINED IN
SAID MODIFICATION AGREEMENT, A COpy OF WHICH IS ATTACHED HERETO
AND MADE A PART HEREOF; PROVIDING A SAVINGS CLAUSE; AND PROVIDING
AN EFFECTIVE DA TE OF THIS ORDINANCE.
WHEREAS, the CITY OF LaPORTE, as Lessor, and GREGORY AVIATION,
as Lessee, have entered into an Airport Lease Agreement dated November 1, 1976;
and
WHEREAS, GREGORY AVIATION, desires that said Airport Lease Agreement
be modified to provide that the term of the Lease begins on the 23rd day of November
e1976 and ends on the 31st day of December 1996; and
WHEREAS, the CITY OF LAPORTE has agreed with the said GREGORY
A VIA TION, upon the terms, conditions, and agreements of a modification of
said Lease;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF LAPORTE:
Section 1. That the Mayor and the City Clerk of the CITY OF LAPOR TE, Texas,
be, and they are hereby authorized and directed to execute for and on behalf of said
City a modification of the existing agreement of Lease with GREGORY A VIA TION,
ea co-partnership, providing therein that the term of the Lease shall begin on
November 23, 1976 and end on December 31, 1996, according to the terms, provisions,
and conditions contained in such agreement, a copy of which is attached hereto,
incorporated by reference herein and made a part hereof for all purposes.
Section 2: If any section, paragraph, clause, or sentence shall be declared
void and unenforceable or unconstitutional, it is hereby declared to be the intention
of the Commission that the remainder of such Ordinance shall remain in full force

Section 3. This Ordinance shall take effect and be in force from and after
its passage and approval.

MODIFICA TION OF AIRPORT LEASE AGREEMENT
This Agreement made and entered into by and between the CITY OF
LAPOR TE'~ Texas, a municipal corporation of Harris County, Texas, hereinafter
called "LESSOR, II and GREGORY AVIATION, a co-partnership, composed of
ROBER T A. GREGORY and JAMES M. WILLIAMS, of Harris County, Texas,
hereinafter called "LESSEE, II
WIT N E SSE T H:
WHEREAS, the parties hereto have heretofore entered into an Airport
. Lease Agreement dated November 1, 1976 affecting property therein described,
situated in the LAPORTE MUNICIPAL AIRPOR T, LaPorte, Harris County, Texas;
and
WHEREAS, the parties desire to modify Article II on Page 1 of said Airport
Lease Agreement;
NOW, THEREFORE, in consideration of the agreements contained herein,
the parties hereto agree as follows:
I.
Article II on Page 1 of the existing Airport Lease Agreement dated November 1,
1976 is modified as follows:
. The term of this Lease shall begin on the 23rd day of November 1976 and
end on the 31st day of December 1996.
Upon the expiration date of this Lease, no notice to quit possession shall. be
necessary, and LESSEE covenants to peaceably surrender possession of the premises
to LESSOR on that date,

In consideration of the sum of ONE DOLLAR ($1. 00) this date paid by LESSEE
to LESSOR, the receipt and sufficiency of which is hereby acknowledged, LESSOR
has entered into this agreement,

III.
All provisions of the Airport Lease Agreement dated November 1, 1976
are incorporated herein and are hereby modified to conform herewith but in all
other respects are to be and shall continue in full force,
IV,
LESSOR covenants that LESSOR has good right and lawful authority to
execute this agreement.
IN WITNESS WHEREOF, the parties hereto have hereunto signed and
sealed this instrument in several duplicate originals, this the 22nd
