ORDINANCE NO.. /.:L ~ ID AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, PROVIDING FOR A PI.ANNING AND ZONING COMMISSION COMPOSED OF SEVEN MEMBERS; PROVIDING THAT SIX OF THE SEVEN MEMBERS SHALL BE RESIDENTS OF THE SIX DISTRICTS FROM WHICH THEY ARE APPOINTED; PROVIDING THAT THE SEVENTH MEMBER SHALL BE THE CHAIRMAN1> FINDING COMPLIANCE WITH THE OPEN MEETING LAW; PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. Section 2-17 of the Code of Ordinances of the City of La Porte hereby amended and shall hereafter read as follows: .... ~. "There is hereby created and established a planning and zoning co~mission, which shall be composed of seven (7) members. "The members shall be appointed by districts, which districts shall coincide with the dis- tricts for election of Counci1persons of the City. In addition, a member, who shall serve as chairman, shall be appointed from the City at-large." Section 2. Section 2-18 of the Code of Ordinances of the City of La Porte hereby amended and shall hereinafter read as follows: "The members of the planning and zoning com- mission shall be resident citizens in the City and qu~lified voters of the City. Each member who is appointed from a district shall be a resident of the district from which he is.appointed at the time of his appointment and continuously throughout his tenure in office." Se'C'tion 3. Section 2-19 of the Code of Ordinances of the City of La Porte hereby amended and shall hereinafter read as follows: "The members of the planning and zoning commission shall be appointed by the Mayor, subject to confirmation by the City Council. "The initial appointments of the members shall be for terms as follows: Member - District 1, three year term Member - District 2, one year term Member - District 3, one year term Member - District 4, two year term Member - District 5, two year term ..-. Member - District 6, three year term _.. Chairman - one year term - . . .' Ordinance No. , Page 2. "All subsequent appointments of all members shall be for three year terms. "The term of each member shall terminate on April 30, or when his successor has been appointed and qualified." Section 4. Section 2-20 of the Code of Ordinances of the City of La Porte hereby amended and shall hereinafter read as follows: . "Section 2-20. Ele'c'ti"on. 'o'f. Vi"c.e-'chai'rtnan and 'S'ecr'e't'ary Planning and zoning commission shall elect a vice-chairman and secretary from its member- ship. " Section 5. Sub-section (3) of Section 2-21 of the Code of Ordinances of the City of La Porte is hereby repealed. Section 6. All ordinances or parts of ordinances in con- flict herewith are hereby repealed to the extent of such con- flict only. Section 7. The City Council officially finds, deter- mines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the ......., City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law pre- ceding this meeting, as required by the Open Meetings Law, Ar- tic1e 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 8.
