Home My WebLink AboutO-1980-1236 . . - ORDINANCE NO. 1236 AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF CRESCENT DRIVE, IN CRESCENT SHORES SUBDIVISION IN THE CITY OF LA PORTE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. WHEREAS, the City Council of the City of La Porte has been requested by the record owners of all of the property abutting hereinafter described portion of Crescent Drive, in Crescent Shores Subdivision in the City of La Porte, to vacate, abandon, and permanently close that portion of Crescent Drive; and WHEREAS, the City Council of the City of La Porte has e determined, and does hereby find, determine and declare that the hereinafter described portion of Crescent Drive is not suitable, needed, or beneficial to the public as a public road or street, and that the closing of the hereinafter described portion of Crescent Drive is' for the protection of the public and for the public interest and benefit, and that the hereinafter described portion of said Crescent Drive should be vacated, abandoned, and permanently closed; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: e Section 1. Under and by virtue of the power granted to the City of La Porte under its Home Rule Charter and Chap. 13, Title 28, Art. 1175, of the Revised Civil Statues of the State of Texas, 1925, the hereinafter described portion of Crescent Drive is hereby permanently vacated, abandoned, and closed by the City of La Porte, to-wit: . The West one-half (W.l/2) of that portion of Crescent Drive, in Crescent Shores Sub- division, according to the map or plat thereof, recorded in Volume 8, Page 58, of the Map Records of Harris County, Texas, and being the West one-half (W.I/2) of that portion of Crescent Drive situated between Block One (1) and Block Two (2) of Crescent Shores Subdivision, and between the North line of said subdivision, and the North right-of-way line of Edgewood Avenue, extended Easterly. . . e 1236 , Page 2. Ordinance No. Section 2. The City Council officially finds, deter- mines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by e law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 3. It is further described as 'being a portion of land forming a point of intersection with the East end of Edgewood Avenue where it intersects with Crescent Drive. The purpose of this appraisal is to estimate the market value of the subject property. Market value is defined as the high- est price estimated in terms of money which a property will bring if exposed for sale in the open market allow~ng a reasonable time to find a purchaser who buys with knowledge of all the uses to which it is adapted and for which it is capable of being used.
