ORDINANCE NO. /..2 ..zS- AN ORDINANCE AMENDING THE CODE OF ORDINANCES BY REPEALING SECTIONS 8-71 THROUGH 8-104, BOTH INCLUSIVE (CHAPTER 8, ARTICLE VII, HOUSE MOVING) AND BY ADDING SECTION 8-18 PRESCRIBING AMOUNTS AS REQUIREMENTS FOR BONDS FOR THE MOVING OF BUILDINGS: FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00): AND PROVIDING AN EFFEC- TIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. Chapter 8, Article VII, (Sections 8-71 through tt 8-104, both inclusive) of the Code of Ordinances of the City of La Porte is hereby repealed. Section 2. The Code of Ord inances of the Ci ty of La Porte is hereby amended by adding Section 8-18, as follows: "Section 8-18. Moving of Buildings - Bond. The building inspector is instructed to prescribe the amount of One Thousand Dollars ($1,000.00) as the requirement for bonds executed in accordance with Southern Standard Building Code, Section 2204.4, provisions concerning moving of buildings." Section 3. The Code of Ordinances of the City of La Porte is hereby amended by adding Section 8-19, as follows: - "Section 8-19. Moving of Buildings - Liability Insurance. The holder of a permit for the moving of a building shall be required to carry liability insurance in the following sums: (1) The minimum sum of fifty thousand dollars ($50,000.00) for injury or death of one person, or one hundred thousand dollars ($100,000.00) for injury or death to more than one person from any one accident; and -- (2) The minimum sum of twenty-five thousand dollars ($25,000.00) for property damage for anyone accident. Such pOlicy shall contain a provision obli- gating the insurer to give written notice of cancellation, not less than ten (10) days prior to the date of such cancellation, to the building inspector. The City Council officially finds, determines, reci tes and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated: and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 6. Any person, as defined in Section 1.07(27), Texas Penal Code, who shall violate any provision of this ordi- nance, shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine not to exceed Two Hundred Dollars ($200.00) . Each day any violation of this ordinance shall con- tinue shall constitute a separate violation. Section 7. This Ordinance shall be effective fourteen (14) days after its passage and approval. The City Secretary shall give notice of the passage of this ordinance by causing the caption hereof to be published in the official newspaper in the Ci ty of La Porte at least twice wi thin ten (10) days after the passage of this ordinance. . e fI e . e Ordinance No. /~~~ , Page 3.
