AN ORDINANCE PROVIDING FOR AN ELECTION TO BE HELD AUGUST 9,
1980, FOR THE ELECTORS OF THE CITY, .OF LA PORTE, TEXAS, TO
ACCEPT OR REJECT THE AMENDED CITY CHARTER OF SAID CITY: DESIG-
NATING ELECTION PRECINCTS AND POLLING PLACES: PROVIDING FOR
THE USE OF VOTING MACHINES: APPOINTING ELECTION OFFICIALS:
PROVIDING FOR METHOD AND DATES OF ABSENTEE VOTING: PROVIDING
FOR RETURN AND CANVASS OF VOTES OF SAID ELECTION: PROVIDING
FOR NOTICE: PROVIDING A SAVINGS CLAUSE: FINDING COMPLIANCE
WITH THE OPEN MEETINGS LAW: AND PROVIDING AN EFFECTIVE DATE
HEREOF.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE:
Section l. An election shall be held within the corporate

limits of the City of La Porte, Texas, on the 9th day of August,
1980, such day being the second Saturday in August, 1980,
between seven o'clock (7:00) A.M. and seven o'clock (7:00)
P.M., at which there shall be submitted to the resident qualified
voters of the City of La Porte, for their acceptance or rejec-
tion, the comprehensive amendment to the Home Rule Charter of
the City of La Porte, Texas, as attached hereto as Exhibit
"A", incorporated by reference herein, and made a part hereof
for all purposes.
Section 2. Said election shall be held at each of the
following voting places wi thin said City, and the following
~ named persons are hereby appointed as officers of said election,
to-wit:
Election Precinct No. l: All voters living in such Pre-
cinct No. I (consisting of that portion of the City of La Porte
which is located east and north of the Southern Pacific Rail-
road) shall vote at the La Porte Senior High School Student
Lounge, which is located at Park Street and East Fairmont
Parkway in the City of La Porte, Texas, with the following
election officers:

Election Precinct No.2: All voters living in such Pre-
cinct No.2 (consisting of that portion of the City of La Porte
which is located west and south of the Southern Pacific Rail-
road, except the territory of the former City of Lomax) shall
vote at the Baker School Cafetorium, which is located at West
Main Street and Underwood Road, La Porte, Texas, with the
following election officials:

Election Precinct No.3: All voters living in such Pre-
cinct No.3 (consisting of that portion of the City of La Porte
which was formerly within the city limits of the City of Lomax,
Texas) shall vote at the former Lomax City Hall building,
which is located at l508 Lomax School Road, La Porte, Texas,
with the following election officials:

The Presiding Judge at each of the above specified polling
places shall appoint as many clerks as he or she deems neces-
sary for the proper conduct of said election at said polling
place, provided that at least two clerks shall be appointed
in each case.
Section 3. Absentee voting by personal appearance shall
begin on the 20th day and shall continue through the 4th day
preceding the day of the election. Except as authorized herein,
the clerk shall not permit anyone to vote absentee by personal
appearance on any day which is not a regular working day for
the clerk's office, and under no circumstances shall he permit

anyone to vote absentee by personal appearance at any time
when his office is not open to the public.
Absentee voting by mail shall begin on the 20th day pre-
ceding the date of the election and shall continue until ten
o'clock (10:00) A.M. on the second day preceding election day.
Absentee voting shall be conducted by a clerk for absentee
voting, namely, Lou Lawler , and the
place at which the absentee voting shall be conducted is desig-
nated as the Administration Building, La Porte Independent
School District, 30l East Fairmont Parkway, La Porte, Texas,
to which address ballot applications and ballots voted by mail
may be mailed. Said clerk shall keep said office open for
absentee voting during his regular working hours and in any
event for at least eight (8) hours on each day which is not a
Saturday, a Sunday, or an official State holiday. Said clerk
for absentee voting is hereby authorized and directed to appoint
deputy absentee balloting clerks, as necessary.
Section 4. The City Commission of the Ci ty of La Porte
hereby finds, determines and declares that it is impracticable
to segregate each subject so as to permit a vote of "yes" or
"no" on the same, for the reason that the amended charter is
so constructed that in order to enable it to work and function
it is necessary that the comprehensive amendment be adopted
in its entirety. For these reasons, the City Commission directs
that the comprehensive amendment be voted upon as a whole.
Section 5. Voting machines shall be used at said election,
and the ballots for said election shall have written or printed
thereon the following:

Section 6. That all election materials including notice
of the election, ballots, instruction cards, affidavits and
other forms which voters may be required to sign and all absentee
voting materials shall be printed in both English and Spanish,
or Spanish translations thereof shall be made available in the
circumstances permitted and in the manner required by law.
Section 7. Notice of said election shall be given by
posting a copy of the notice containing a substantial copy of
~ this Ordinance, at the City Hall in the City of La Porte, Texas,
and by publication thereof, in The Bayshore Sun, a newspaper
of general circulation publiShed in said city, on the same day
in each of two successive weeks, the date of the first publi-
cation to be not less than fourteen (l4) days prior to the date
set for said election: and, not less than thirty (30) days
prior to such election, the City Clerk shall mail a copy of the
proposed amendments to each qualified voter in the City of
La Porte, Texas, as appears on the voter registration rolls of
the Tax Collector of Harris County, Texas.
~ Section 8. Said election shall be held in accordance with
the provisions of the City Charter of the City of La Porte, and
the general election laws of the State of Texas governing
general and municipal elections, so far as same may be applicable
thereto.
Section 9. Immediately after said election, the officers
holding the same shall make and deliver the returns of the
resul ts thereof and the accompanying records for use in the
official canvass to the City Commission of the City of La Porte,
and the City Commission shall canvass said returns at the
e earliest practicable time, and shall, immediately after can-
vassing the returns, declare the results of the election.

Section lO. In the event that the official canvass of
said election shall show that said amendment was approved by
the qualified voters, said amendment shall be effective when
the official order declaring the results of said election has
been entered upon the records of the City of La Porte, and the
Mayor shall, as soon as practicable after the entry of said
order, certify to the Secretary of State of the State of Texas
an authenticated copy of said amendment under the seal of the
City, showing approval by the qualified voters.
Section ll. Each and every provision, paragraph, sen-
tence and clause of this Ordinance has been separately con-
sidered and passed by the City Commission of the City of
La Porte, Texas, and each said provision would have been
separately passed without any other provision, and if any
provision hereof shall be ineffective, invalid or unconsti tu-
tional, for any cause, it shall not impair or affect the
remaining portion, or any part thereof, but the valid portion
shall be in force just as if it had been passed alone.
. Section l2. The City Commission officially finds, deter-
mines, recites and declares that a sufficient written notice of
the date, hour, place and subject of this meeting of the City
Commission was posted at a place convenient to the public at the
Ci ty Hall of the City for the time required by law preceding
this meeting, as required by the Open Meetings Law, Article
6252-17, Texas Revised Civil Statutes Annotated: and that this
meeting has been open to the public as required by law at all
times during which this ordinance and the subject matter thereof
has been disc ussed, cons idered and formally acted upon. The
Ci ty Commission further ratifies, approves and confirms such
~ written notice and the contents and posting thereof.

Section 13. This Ordinance shall be in effect immediately
upon its passage and approval.

de La Porte, para su aceptacion 0 su rechazo, la enmienda
comprensiva a la carta de gobernacion local de la ciudad de La
Porte, Tejas, como suministrada aqui como exihibicion A,
incorporada por referencia aqui, y hecha una parte para todas

Seccion 2. Dicha eleccion se celebrara en cada uno de los
lugares siguientes de votacion dentro de dicha eleccion, y las
siguientes personas se nombran por la presente como oficiales

de dicha eleccion, espicificamente:
Barriada de eleccion num. 1 - Cada votante viviendo en tal
barriada (la parte de la ciudad colocada al este y al norte del

ferrocarril) votara a la escuela superior de La Porte, en el salon
de estudiantes, ubicada a la calle Park y Fairmont Parkway oriental
en la ciudad de La Porte, Tejas, con las siguientes oficiales de
eleccion:

Barriada num. 2 - Cada votante viviendo en tal barriada (la
parte de la ciudad de La Porte colocada al oeste y al sur del

Main y Underwood, La Porte, Tejas, con los sigiuentes oficiales de

1508 Lomax Road, La Porte, Tejas, con los siguientes oficiales
de eleccion:

El juez principal en cada uno de los lugares de votar ya
mencionados nombrara tantos dependientes como el 0 ella se ve
necesarios para dirigir dicha eleccion en dicho lugar de votar,
con tal que por lo menos dos dependientes sean nombrados en cada
caso.
Seccion 3. La votacion en ausencia por aparecer persona1-
,
mente, empezara el dia 20, y seguira hasta el cuarto dia antes
del dia de la eleccion. Excepto como autorizado aqui, el
,
dependiente no permitira que nadie vote en ausencia por aparecer
persona~ente sobre cualquier dia que no sea dia regular de
trabajo para la oficina del dependiente, y bajo ningunas
,
circunstancias puede ese permitir que cualquier persona vote
en ausencia cuando su oficina no esta abierta al p~blico.
La votacion en ausencia se conducira por un dependiente de
esta clase de votacion, es decir,

y el lugar de la votacion en ausencia esta designado como el
edificio administrativo, distrito escolar independiente de La
Porte, 30l East Fairmont Parkway, La Porte, Tejas, y a esta
direccion se puede enviar las aplicaciones para la balota de
votar y tambien 1as balotas votadas por correo. Dicho dependiente
quardara abierta dicha oficina para la votacion en ausente
durante sus regulares horas de trabajo, y en todo caso para por
lo menos ocho (8) horas durante cualquier dia que no sea un
sabado, domingo, 0 dia de vacacion oficial estatal. Dicho

dependiente por esto esta autorizado y dirigido nombrar dependientes
ayudantes, como necesarios.

Seccion 4. El ayuntamiento de la ciudad de La Porte por
esto halla, determina y declara que no es practicable segregar
cada sujeto de tal manera para permitir un voto de "SI" 0 "NO",
porque la carta enmendada esta construida de tal manera que para
permitirla funcionar correctamente, es preciso que la enmienda
comprensiva sea adoptada por completo. Para estas razones, el
ayuntamiento ordena que la enmienda comprensiva sea puesta a la
votacion como por completa.

SeCC10n 5. Las maqu1nas de votar se usaran en dicha elecc10n,
y las balotas de dicha eleccion luciran lo siguiente:

seccibn 6. Que todas las materias de la eleccion, inclusive
noticias de la eleccion, balotas, tarjetas instructivas, actas

ellas estaran disponibles en las circunstancias permitidas y
en la manera requerida por la ley.

Noticias de dicha eleccion se haran p~blicas por
mostrar una copia de las noticias que contienen una copia
substancial de esta ordenanza en la casa consistorial de La Porte,
Tejas, y tambi~n por publicarla en el Bayshore Sun, un periodico
de circulacion general publicado en dicha ciudad, el mismo dia
en cada de dos semanas sucesivas, la fecha de la primera publicacion
no menos de catorce (14) dias antes de la fecha de dicha eleccion:

y, no menos de treinta (30) dias antes de tal elecc10n, el
dependiente municipal enviar~ una copia de las enmiendas propuestas
a cada votante calificado en la ciudad de La Porte, Tejas, como
aparece en las listas de registracion de votantes del recaudador
de condado Harris, Tejas.
Seccibn 8. Dicha eleccion se celebrara de acuerdo con las
provisiones de la carta municipal de la ciudad de La Porte, y de las
leyes generales de elecciones del estado de Tejas que gobiernan
las elecciones generales y municipales, hasta el punto que ellas
pueden aplicarse.

Secci~n 9. Anmediamente despuis de dicha eleccion, los
oficiales encargados de la misma, entregar~n los resultados y
~
datas acompanantes que pueden servir en el recuento oficial al

ayuntamiento de la ciudad de La Porte, y el ayuntam1ento contara
,
dichos resultados tan pronto posible, inmediatamente despues del
, 1 .'
recuento, declarara los resultados de la e eCC10n.
Secci~n 10. Si el recuento oficial de dicha eleccion muestra
que dicha enmienda fue aprobada por los votantes calificados,
dicha enmienda sera efectiva cuando el mandato oficial declarando
los resultados de dicha eleccion se ha puesto en los anales de
la ciudad de La Porte, y el alcalde certificara, tan pronto como
practicable despues de dicho mandato, al secretario del estado
de Tejas una copia autentica de dicha enmienda bajo el sello de
la ciudad, mostrando aprobacion por los votantes calificados.
Secci~n ll. Cada y toda provision, p~rrafo, oraci~n y

clausula de esta ordenanza ha sido considerado seperadamente y
pas ado por el ayuntamiento de la ciudad de La Porte, Tejas, y
,
cada dicha provision hubiera sido pas ado seperadamente sin otra
provision, y si cualquier provision aqui resulta inefectiva,
,
invalida 0 inconstitucional, no podra negar ni afectar la parte
que queda, ni ninguna parte aqui, pero la parte valida quedar~
en vigor como si hubiera pasado por si sola.
Seccion 12. El ayuntamiento oficialmente determina, halla,
recita y declara que noticia suficiente de la fecha, hora, lugar,

y sujeto de esta reun10n del ayuntamiento fue hecha publico en
un lugar conveniente al publico en la casa consistorial de la
ciudad durante el tiempo requerido por la ley antes de esa
reuni~n, como requerido por la ley que gobierna alas reuniones
abiertas, articulo 6252-l7, las revisadas leyes anotadas: y
que esta reuni~n ha sido abierta al publico como requiere la ley
en todos los momentos cuando esta ordenanza y su materia han
sido discutidos, considerados, 0 cuardo habia acciones tomadas
,
oficiales. El ayuntamiento mas ratifica, aprueba y confirma tal
,
noticia escrita y el contenido y el acto de hacer publico esta
ordenanza.
