ORDINANCE NO. 1189
AN ORDINANCE GRANTING A PERMIT TO FRANK MOHN HOUSTON, INC. ,
FOR A FIFTEEN FOOT (IS') WIDE UTILITY EASEMENT ACROSS THE
RIGHT-OF-WAY OF WEST "c" STREET, ADJACENT TO THE WEST FIFTEEN
FEET (W.15') OF LOT ONE (I), BLOCK SEVEN HUNDRED EIGHTY-SEVEN
(787), AND LOT SIXTEEN (16), BLOCK SEVEN HUNDRED SIXTY-TWO (762),
TOWN OF LA PORTE, HARRIS COUNTY, TEXAS; AND PROVIDING THE TERMS
OF SUCH PERMIT AND EASEMENT; AND PROVIDING AN EFFECTIVE DATE
HEREOF.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE:
Section 1. The City Commission of the City of La Porte has
received an application dated December 17, 1979, from Frank Mohn
Houston, Inco, requesting a permit to construct a 12 KV electric
line under the west fifteen feet (W.15') of the right-of-way of
West "C" Street, lying and being adjacent to the west fifteen
feet (W.15') of Lot One (1), Block Seven Hundred Eighty-seven
(787), and also Lot Sixteen (16), Block Seven Hundred Sixty-two,
all in the Town of La Porte, Harris County, Texas.
Section 2. The City Commission of the City of La Porte
hereby approves the application of Frank Mohn Houston, Inc.,
dated December 17, 19 79, and this Ord inance shall consti tute a
permit and easement to Frank Mohn Houston, Inc., to lay and con-
struct, and maintain a 12 KV electric line within said easement,
all in conformity with the ordinances of the City of La Porte,
and in conformity with the plans and specifications shown as
attached to said application.
Section 3. Nothing in this Ordinance shall be construed
as permitting or authorizing Frank Mohn Houston, Inc., to sell
or deliver electric power to any other person, firm, or corpor-
ation. It is understood that the purpose of this easement is to
provide electrical inter-connection between properties owned by
Frank Mohn Houston, Inc., which are connected by said easement,
to facilitate electric service to applicant's said properties,
and not otherwise.

Section 4. This easement shall be for a period of twenty
(20) years from the date of this Ordinance.
Section 5. Frank Mohn Houston, Inc., by its acceptance of
this easement, agrees to save and hold harmless the City of
La Porte from any loss, claim, or damage, arising out of its
use or operations within said easement. Frank Mohn Houston, Inc.,
shall obtain all necessary approvals and permits from Houston
Lighting and Power Company in connection with the construction
and operation of its electrical easement herein granted.
Section 6. This Ordinance shall be in full force and effect
from and after its passage and approval.

Dear Mr. Hudgens,
As per our discussion last week, I hereby submit to the City of La Porte
a solution for consideration.

We are currently in our second phase of expansion, which is scheduled
to be co~pleted some time in ~farch of 1980. Consequently, with this ex-
pansion our requirement for electric power has increased substantially.
During the course of events, we asked Levingston Engineers, Inc. to work
out an ecomonical solution for our future electric needs and to co-ordi-
nate their recommendation with Houston Lighting & Power Company.
Therefore, we request the City of La Porte to give consideration to sell
to FMH, INC. 15 feet long,x 60 feet wide right-of-way at the far west end
to enable us to connect our two properties. We would be willing to under
take an agreement with the owner or owners of Builders Supplies, l.,ho own.'
the land west of our properties, to allow their ingress and egress through
the "e" Street.
An alternate request is to grant us an easement to cross with our private
12 KV line through that 15 feet portion of the street per requirements
set forth by City of La Porte and also acceptable to H. L. & P. Company
for the purposes of obtaining single point of service.
