<br />. <br /> <br />. <br /> <br />. <br /> <br />.. <br /> <br />" <br /> <br />. . <br /> <br />ORDINANCE NO. 1173 <br /> <br />AN ORDINANCE AMENDING THE PROVISIONS OF THE CODE OF ORDINANCES <br />CONCERNING DEMOLITION OF BUILDINGS AND OTHER STRUCTURES; PROVID- <br />ING THAT EACH NON-OWNER APPLICANT SHALL FILE A FIVE HUNDRED <br />DOLLAR ($500.00) CASH BOND; PROVIDING THAT ANY PERSON VIOLATING <br />THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MIS- <br />DEMEANOR AND UPON CONVICTION SHALL BE FINED IN A SUM NOT MORE <br />THAN TWO HUNDRED DOLLARS ($200.00); PROVIDING FOR SEVERABILITY; <br />FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN <br />EFFECTIVE DATE HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: <br /> <br />Section 1. Section 8-147 of the Code of Ordinances, City <br /> <br />of La Porte, Texas, is hereby amended to read as follows: <br /> <br />"Section 8-147. Applicant's bond. <br /> <br />"At the time of making an application for a permit under <br />this Division, the applicant shall file with the build- <br />ing inspector, a five hundred dollar ($500.00) cash bond, <br />except that where the applicant is the owner of the property, <br />no bond shall be required. The bond shall be conditioned <br />that the principal, if granted a permit, will accomplish <br />such demolition in strict accordance with the terms of this <br />article, and will pay to the City any expense incurred by <br />it in eliminating fire hazards or other conditions created <br />by such demolition which are detrimental to the public <br />welfare. Such bond shall be made payable to the City and <br />shall inure to the benefit of any person damaged or injured, <br />in any manner, by the principal obligor by reason of such <br />demolition, except the agents, servants or employees of <br />the principal obligor." <br /> <br />Section 2. If any section, sentence, phrase, clause, or <br /> <br />any part of any section, sentence, phrase, or clause, .of this <br /> <br />ordinance shall, for any reason, be held invalid, such invalidity <br /> <br />shall not affect the remaining portions of this Ordinance, and <br /> <br />it is hereby declared to be the intention of this City Commission <br /> <br />to have passed each section, sentence, phrase or clause, or part <br /> <br />theereof, irrespective of the fact that any other section, sentence, <br /> <br />phrase or clause, or part thereof, may be declared invalid. <br /> <br />Section 3. Any person, as defined in Section 1.07(27), Texas <br /> <br />Penal Code, who shall violate any provision of this ordinance, <br /> <br />shall be deemed guilty of a misdemeanor and upon conviction shall <br /> <br />be punished by a fine not to exceed Two Hundred Dollars ($200.00). <br /> <br />Each day any violation of this ordinance shall continue shall <br />constitute a separate violation. <br />
