HomeMy WebLinkAboutR-1966-54 . e RESOLUTION 6 ~ -..54 e WHEREAS, the City Commission of the City of La Porte has heretofore constructed, and is now the owner and operator of, the City of La Porte Municipal Airport, which is in close proximity to that certain tract of land identified as Parcel D on Exhibit "A" attached hereto, incorporated herein by reference and made a part hereof for all purposes; and WHEREAS, the City Commission of the City of La Porte has found that public necessity requires the acquisition of an aerial navigation easement above said Parcel Dj and WHEREAS, it is deemed necessary that that portion of .~ Parcel D which lies within the North West Clear Zone approach area of the N.W.-S.E. runway of said Airport be and remain free and clear of any structure, tree, or other object which is or would constitute an obstruction 'or hazard to the flight of aircraft in landing and taking-off at the said airport, which said clear zone approach area is more particularly described hereinafterj and WHEREAS, the City Commission of the City of La Porte has found and determined that an aerial navigation easement over and above the hereinafter described land is needed and suitable for such purpose, and that it is necessary to acquire said easement .. for said airport clear zone as aforesaid: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: That the City Attorney of the City of La Porte be, and he is hereby, authorized to negotiate with the owners of such hereinafter described land, for the acquisition of an aerial navigation easement over said land, as hereinafter described, at the fair market value for such easement, and should the City Attorney, as the duly authorized representative of the City of La Porte, be unable to agree with such owners as to the fair market value of such easement, then, and in that event, the City Attorney of the City of La Porte be, and he is hereby, authorized and directed --. e e .. .- e . -2- to file against all owners and lien holders, proceedings in eminent domain to acquire an aerial navigation and clear zone easement, from and out of a portion of La Porte Out lots Four Hundred Seventy-Nine (479), Four Hundred Eighty (480), and Four Hundred Eighty-One (481), in the Enoch Brinson Survey, A-5, Harris County, Texas, according to the map or plat thereof recorded in the office of the County Clerk of Harris County, Texas, the portion of said La Porte Outlot.s said clear zone area is located, being more particularly described as follows: Beginning for reference at a i" iron pipe found for the Northwest corner of.the La Porte Municipal Airport; Thence N 89036' W, 332.28' to point for corner in the Southwest line of the Northwest clear zone of the N.W. - S. E. Runway of the La Porte Municipal Airport, and being the point of beginning of this tract; Thence, N 57057'55" W, 210.33' to the Northwest corner of the said clear zone; Thence, N 37044'34" E, 450' to the most Northerly corner of the said clear zone; Thence, S 46042'39" E, 1,004.99' to the Southeast corner of the said clear zone; Thence, S 37044'34" W, 250' to the most southerly corner of the said clear zone; Thence, N 57057'55" w, 794.66' to the place of beginning of this clear zone tract; and being more particularly described and identified as Parcel D on Exhibit "A" attached hereto, incorporated by reference herein, and made a part hereof for all purposes.
