HomeMy WebLinkAboutO-1981-1144-A . . .e ORDINANCE NO. 1144A AN ORDINANCE AMENDING THE LA PORTE FIRE CODE, ORDINANCE NO. 1144, BY AMENDING ARTICLE 36, FIRE CODE REVIEW COMMITTEE; , FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. Article 36: Fire Code Review Committee of the La Porte Fire Code, Ordinance No. 1144 of the Ordinances of the City of La Porte, Texas, is hereby amended and here- after shall read as follows: "Article 36: Fire Code Review Committee e "Division 1: General "Section ,36-1 Fire Code review board established; composition; appointment; term; meetings; duties of board; quorum constituted; filling of vacancies. "There is hereby established a fire code review board which shall consist of fifteen (15) members. Such members shall be appointed by the mayor, with the approval of the city council and shall be composed of the following: "(a) position I by the fire marshal of the City of La Porte or his duly authorized representative. "(b) Position 2 by the fire chief of the City of La Porte e or his duly authorized representative. "(c) Position 3 by the director of public works of the City of La Porte or his duly authorized representative. "Cd) Position 4 by the chief building inspector of the City of La Porte or his duly authorized representative. II (e) position 5 by the city manager of the City of La Porte or his duly authorized representative, who shall be the chair- man. n(f) Positions 6 through 15, both inclusive, shall be filled by ten (10) registered voters who are residents of the City of La Porte. e . . Ordinance No. 1144A e , Page 2. e "Nine (9) members at a meeting shall constitute a quorum. nThe legal department shall have an attorney available to advise the board on legal matters relative to topics under board jurisdiction. nThe fire marshal or his duly authorized representative shall be the secretary of the board. "The terms of all members of the board shall be of two (2) years in length or until a successor is appointed and qualified. nWhenever any position on the board becomes vacant by reason of death, resignation, or removal, the mayor shall, with the approval of the city council, appoint another qualified person to the vacant position, and such appointment shall be for the unexpired term of the member being replaced. n The duties of the f ire code review board shall be: To recommend changes in the fore code; to interpret the provisions of the fire code; to hear appeals from decisions of the fire chief or fire marshal; and in cooperation with the fire marshal, to submit an annual report to the mayor and city council con- taining a summary of the actions of the fire code review board during the preceding year together with recommendations for amendments to the fire code." e Section 2. Except as hereby amended, all remaining pro- visions of the City of La Porte Fire Code shall remain in full force and effect. Section ,3. This Ordinance shall take effect and be in force from and after its passage and approval. e Section ,4. The City Council officially finds, deter- mines, recites and declares that a sufficient written notice . . Ordinance No. 1144A e , Page 3. of the date, hour, place and subject of this meeting of the Ci ty Council was posted at a place convenient to the public at the City Hall of the Ci ty for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject e matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. PASSED AND APPROVED this the 16th day of September, 1981. CITY OF LA PORTE ~, J. J.
