ORDINANCE NO. 1139
.
AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF THE
INTERSECTION OF NORTH HOLMES AVENUE AND EAST "D" STREET; AND
PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, the City Commission of the City of La Porte has
been requested by the record owners of all of the property
abutting the hereinafter described portion of the intersection
of North Holmes Avenue and East "D" Street, to vacate, abandon,
and permanently close said portion of the intersection of
North Holmes Avenue and East liD" Street; and

WHEREAS, the City Commission of the City of La Porte has
determined, and does hereby find, determine and declare that
the hereinafter described portion of the intersection of North
Holmes Avenue and East "0" Street is not suitable, needed, or
beneficial to the public as a public road or street, and that
the closing of the hereinafter described portion of the inter-
section of North Holmes Avenue and East "D" Street is for the
protection of the public and for the public interest and
benefit, and that the hereinafter described portion of said
intersection of North Holmes Avenue and East "D" Street should
be vacated, abandoned, and permanently closed;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF LA PORTE:
Section l. Under and by virtue of the power granted to
the City of La Porte under its Home Rule Charter and Chap. l3,
Title 28, Art. II 75, of the Revised Civil Statues of the State
of Texas, 1925, the portion of the intersection of North Holmes
Avenue and East " D" Street, which portion is described in
Exhibit "A" and pictured in Exhibit "B", each of which Exhibits
are attached hereto and made a part hereof by reference, is
hereby permanently vacated, abandoned, and closed by the City
of La Porte.

Section 2. This Ordinance shall take effect and be in
force from and after its passage and approval.

FIELD NOTE DE~CRIPTJON
Being a 0.1528 acre (6,655 square feet) tract of land and being that
portion of the intersl~ction of North Holmes Avenue and East "D" street,
as herein described, La Porte, First Division, and Refiling of a portion
of Bayfront Addition, La Porte, Harris County, Texas, out of the Johnson
Hunter Survey, A-35, c~ recorded in Volume 1, at Page 27, Harris County
Map Records, said 0.1528 acre tract being more particularly described
as follows:
BEGINNING at a 5/8 inch iron rod set for the Northwest corner of
Block 986, La Forte, First Division, as recorded, said point being
in the East right-of-way line of North Holmes Avenue based on a right-
of-way width of 60 feet, and being also the Northwest corner of Lot 13,
Block 986;
Thence, N 270 15'W, along a Northerly projection of the East right-
of-way line of North Holmes Avenue, a distance of 66.l6 feet to a 5/8
inch iron rod set for a point of curve;
Thenc~Jin a Northeasterly direction, following a curve to the right,
said curve .ha,ving a ra.dius of 30 feet and a central angle of 1170 15',
'a curve distance of 61.39 feet to a 5/8 inch iro~ rod set for a point
of tangency in a Westerly projection of the South right-of-way line of
East "D" street, based on a right-of-way width of 80 feet;
Thence, East, along the Westerly projection of the South right-of-way
line of East "D" street., a distance of 91.41 feet to a 5/8 inch iron rod
~et at the point of intersection of the South right-of-way line of ~ast
"D" Street with 'the \.,rest line of the 16 foot wide alley in said Block
986, said point being also the Northeast corner of said Lot 13;
Thence, S 4Qo ))' 49" W, along the Northwest line of Lot 1), Block
986, a distance of 135.00 feet to the POINT OF BEGIh~ING.
