ORDINANCE NO. 1140 AN ORDINANCE CALLING BOND ELECTION; PROVIDING AND FIXING DETAILS RELATING THEP~TO; AND DECLARING THAT SAID ORDINANCE SHALL BE EFFECTIVE IMMEDIATELY UPON ADOPTION WHEREAS, the City Commission has determined and hereby determines, that the ~ropositions for the issuance of tax bonds of said City for the purpos,e of making certain _permanent public improvements, as hereinafter provided, should be submitted at an election as hereinafter provided; and WHEREAS, the City Commission wishes to proceed with the ordering of such election; Therefore, BE IT ORDAINED BY THE CITY COMMISSION OF' THE CITY OF LA PORTE: ~ Section 1. That a special election shall be held in and throughout the city of La Porte, Texas, on.the 24 day of FEBRUARY " 1979, which is not less than fifteen nor more ,than ninety days from the date of this ordinance, at which election there' shall be aubmitted to the duly qualified resident electors within said City, for their action there- .upon, the following propositions, to-wit: PROPOSITION NO. 1 SHALL THE CITY CO~~I~SION OF THE CITY OF LA PORTE, TEXAS, BE AUTHORIZED'TO ISSUE THE TAX BONDS OF SAID CITY, IN ONE OR MORE SERIES OR ISSUES, IN THE AGGREGATE PRINCIPAL AMOUNT OF $2,000,000, MATURING SERIALLY WITHIN 25 YEARS FROM THEIR DATE OR DATES, AND BEARING INTEREST AT A RATE OR RATES NOT TO EXCE~D THE ~~XIMUM NOW OR HEREAFTER AUTHORIZED BY LAW, ALL AS SHALL BE DETEm1INED WITHIN THE DISCRETION OF THE CITY COMMISSION, FOR THE PURPOSE OF EXTENDING AND IMPROVING THE CITY'S EXISTING SANITARY SEWER SYSTEM, fu~D TO LEVY TAXES UPON ALL TAXABLE PROPERTY WITHIN SAID CITY ANNUALLY, SUFFI- CIENT TO PAY THE INTEREST ON SAID BONDS AS IT ACCRUES, AND TO CREATE AND PROVIDE A SINKING FUND TO PAY THE PRINCIPAL OF SAID BONDS AS THEY ~~TURE? Section 2. Said election shall be held at each of the following voting places within said City, and_ the following named persons are hereby appointed as officers of said e1ec- . tion, to-wit: ~Election Precinct No.1: All voters living in such Pre- cinct No. 1 (consisting of that portiop of the City of La Porte which is located east and north of the Southern Pacific Railroad) shall vote -at the La Porte Senior High School Student Lounge, which is located at Park Street and East Fairmont Parkway, in the City of La Porte, Texas, with the following election_officers: LOU LAWLER , Presiding Judge JACK GRESHAM , Alternate Presiding Ju~ge All' voters living in such Pre- Election Precinct No.2: cinct No. 2 (consisting of that portion of the City of La Porte which is located west and south of the Southern Pacific Railroad) shall vo'te at the Bak~r School ~afetorium, which is located at West Main Street and Underwood Road, La Porte, Texas, with the following election officials: JANET GRAVES , Presiding Judge ED E'ERGUSON , Alternate Presiding Judge The Presiding Judge at each of the above specified poll- ing places shall appoint as many qlerks as he or she deems necessary for the proper conduct of said election at said polling place, provided that at least two clerks shall be appointed in each case. Section 3. Voting at said election, including absentee v~ting, shall be by the use of voting machines, and the ballots of said ell~ctions shall conform to the Texas Election Code, as amended, and shall have printed thereon the following: -2- 4", ...., e. e . .. . . OFFICIAL BALLOT PROPOSITION NO. 1 FOR AGAINST The issuance of $2,000,000 sewer system 'improvement bonds,' and the levying of the tax in paYment thereof. PROPOSITION NO. 2 FOR AGAINST The issuance of $1,250,,000 water works systemirnprovement bonds, and the levy- ing of the tax in payment thereof. As to each proposition, each voter desiring to vote in favor of the proposition shall pull the voting pointer down indicating "For" such proposition, and each voter desiring to vote against the proposition shall pull the voting pointer down indicating "Against" such proposition. Absentee voting shall be conducted by the City Clerk, Margie Goyen, at hl9r regular office in the City Hall" 10- cated at 604 West :Irairmont Parkway, La Porte, Texas, to which address balll:>t applications and ballots voted by mail may be sent. Said clerk shall keep said office open for absentee voting du:t:'ing her regular working hours and in any event for at least 8 hours of each day which is not a Saturday, a Sunday, or an official State Holiday. Section 4. That all election materials including no- tice of the election, ballots, instruction cards, affi- dav'its, and other forms which voters may ];>e required to sign and all absen'tee voting materials shall be printed in both English and Spanish, or Spanish translations thereof and/or other assis'tance shall be provided, as required by -3- -. " \ . . the Texas Election Code and the Federal Voting Rights Act e. of 1965, each as amended. Section 5. That notice of said election shall be given by posting a copy thereof containing a substantial copy of this ordinance at the City Hall and at one other public place within each Voting Precinct of said City not less than fourteen (14) days prior to the date, upon which said election is tcJ be held, and by publishing such notice on the same day in each of two (2) successive weeks in the Bayshore Sun, the first such publications 'to be not less e than fourteen (14) days prior to the date set for said election. It is hE:!reby found and declared that the Bay- shore Sun is a newspaper of general circulation within said City. Section 6. Said election shall be held in accordance with the provisions of the City Charter of the City of La Porte, 'Texas, and the general election laws of the State of Texas governing general and municipal elections, so ,far as same may be applicctble thereto. The City Commission of the City of La Porte, Texas, convened in special session, open to the ,public and duly noticed in,accordance w~th Article 6252-17, V.A.T.C.S., as amended, at the regular meeting place thereof in, the City Hall, within said City, on the 17th day of January , 1979, with the following members present, to-wit: J. J. Meza Mayor Virgini,a Cline Commissioner John L. Tomerlin Commissioner Tom Simons Commissioner 'e I. J. Kibodeaux Commissioner and the following members absent, to-wit: none , when, among other business, the fo1lowin~ was transacted, to-wit: The Mayor introduced an ordinance which was read in full. Commissioner Cline moved that the ordinance be adopted as read. Commissioner Simons seconded ,the motion for adoption of said ordinance. The motion, carry- ing with it the adoption of the ordinance, prevailed by the following votes: - AYES: 5 NOES: o The Mayor thereupon announced that the motion had duly and lawfully carried and that the ordinance had been duly and lawfully adopted.
