ORDINANCE NO. 1126 - AN ORDINANCE AMENDING CHAPTER I,P, ARTICLE I OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, PROVIDING THAT IT SHALL BE A NUISANCE TO POSSESS, TRANSPORT, OR DETONATE FIREWORKS WITHIN THE CITY LIMITS AND WITHIN A DISTANCE OF FIVE THOUSAND FEET (5000') OUTSIDE OF THE CITY; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00); AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: Section 1. Section 10-2(a) Code of Ordinances, City of La Porte, Texas is hereby amended to read as follows: - II (a) Except as otherwise specifically provided in this section, it shall be a nuisance and it shall be unlawful for any person to manufacture, assemble, store, transport, rec.eive, keep, sell, offer, or have in his possession with intent to sell, use, discharge, cause to be discharged, ignite, detonate, fire or otherwise set in action any fireworks of any description, within the city limits and within a distance of Five Thousand Feet (5000') outside the city and not within any other city.1I Section 2. Any person as defined in Texas Penal Code Section 1.07 (27) who shall violate any provision of this Ordinance, shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine not to exceed Two Hundred Dollars ($200.00). Each day any violation of this Ordinance shall continue shall constitute a separate offense. Section 3. This Ordinance shall be effective fourteen (14) days after its passage and approval. The City Clerk shall give notice of the passage of this ordinance by causing the caption ~ hereof to be published in the official newspaper in the City of La Porte at least twice within ten (10) days after the passage of this ordinance. Section 4. If any section, sentence, phrase, clause, or any part of any section, sentence, phrase, or clause, of this ordinance shall, for any reason, be held invalid, such invalidity shall not affect the remaining portions of this Ordinance, and it is hereby declared to be the intention of this City Commission to have passed each section, sentence, phrase, clause, or part thereof, irrespective of the fact that any other section, sentence, phrase . . . -2- ~ or clause, or part tnereof, may be declared invalid. e e .
