AN ORDINANCE AMENDING CHAPTER 21, SECTIONS 25 AND 28, OF THE
CODE OF ORDINANCES OF THE CITY OF LA PORTE, PROVIDING THAT ALL
CHURCHES AS DEFINED IN THE ORDINANCE SHALL BE EXEMPT FROM
PAYMENT OF APPLICATION FEE AND APPRAISED AMOUNT FOR VACATING,
ABANDONING AND CLOSING STREETS AND ALLEYS; AND PROVIDING AN
EFFECTIVE DATE HEREOF.

BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE:
Section 1. Section 21-25, "Application fee" under Chapter
21 STREETS AND SIDEWALKS, Article III "Vacating, Abandoning and
Closing Streets and Alleys," of the Code of Ordinances of the
City of La Porte, is hereby amended to include subsection (c)
as follows, to-wit:
"(c) Any corporation or association organized and
operated exclusively for religious purposes, no part of the
net earnings of which inure to the benefit of any private

shareholder or individual, shall be exempted from the payment
of an application fee under this section."
Section 2. Section 21-28, "Final determination by
commission; appraisal; conveyance" under Chapter 21 STREETS
AND SIDEWALKS, Article III "Vacating, Abandoning and Closing
Streets and Alleys," of the Code of Ordinances of the City of
La Porte, is hereby amended and shall hereafter read as
follows, to-wit:
"Sec. 21-28. Final determination by commission; appraisal;
conveyance.

Upon compliance with all provisions of this article,
the city commission shall make a final determination as
to whether or not an application filed under this article
shall be granted or denied. Streets or alleys, whether
owned by the city in fee or used by easement, may be sold
to the abutting owner or owners in proportion to their
abutting ownership, such division between owners to be
made in an equitable manner. In addition, any land or
interest therein which was originally acquired for the
purpose of streets, rights-of-way or easements which the
city chooses to trade or exchange as consideration for
other land acquired for streets, rights-of-way or ease-
ments, including transactions which may be partly for
cash and partly by trade or exchange. Nothing in this
article shall require the city commission to accept any
bid or offer or be required to consummate any sale or
trade. Any conveyance, sale or trade made under this
article shall never be for less than the fair market
value of the land or interest being conveyed, sold or
traded, as determined by an appraisal obtained by the
city commission at applicant's expense, which shall be
conclusive of the market value thereof; all as provided
in Art. 542lc-12, Revised Civil Statutes. Provided,
however, that any corporation or association organized
and operated exclusively for religious purposes, no part
of the net earnings of which inure to the benefit of any
private individual or shareholder, shall be exempted
from the provisions of this section."

after its passage and approval.
