AN ORDINANCE MAKING CERTAIN FINDINGS OF FACT; PRESCRIBING
RATES TO BE CHARGED FOR DISTRIBUTION AND SALE OF NATURAL
GAS WITHIN THE CITY, AND REPEALING ALL OTHER ORDINANCES OR
PARTS OF ORDINANCES IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE:
Section 1. The City Commission of the City of La Porte,
based on an analysis by outside utility consultants, has
attempted to reach a reasonable rate increase agreement with
Entex, Inc. The City Commission finds that Entex, Inc., is
unwilling to negotiate a settlement on the basis of rates
which will produce a reasonable return to that company.
Therefore, the City Commission finds that at this time it will

grant no increase in rates to Entex, Inc., and that the rates
which Entex, Inc., put into effect under bond on or about
August 3, 1977, should terminate effective this date, and that
the rates should be as follows in this rate ordinance, and
that Entex is ordered to file tariffs in accord with the rates
which were in effect prior to the effective date of the bonded
rates.
Section 2. The following rates and charges are hereby
.
fixed as the maximum monthly net rates and charges, and are
hereby authorized for distribution and sale of natural gas in
the City of La Porte to be applied and used by Entex, Inc. ,
(the "Company") , its successors or assigns.
RESIDENTIAL RATES
Net Monthly Rate: The net monthly bill shall be based upon
the following rates:
1. For the billing months May through October:
First 400 cubic feet or less $2.00
Next 2,600 cubic feet at 11. 0 Cents per 100 cu. ft.
Next 3,000 cubic feet at 10.0 Cents per 100 cu. ft.
AllOver 6,000 cubic feet at 3.5 Cents per 100 cu. ft.
MINIMUM MONTHLY BILL $2.00
2. For the billing months November through April:
First 400 cubic feet or less $2.00
Next 2,600 cubic feet at 11.0 Cents per 100 cu. ft.
Next 3,000 cubic feet at 10.0 Cents per 100 cu. ft.
Next 10,000 cubic feet at 8.0 Cents per 100 cu. ft.
AllOver 16,000 cubic feet at 4.5 Cents per 100 cu. ft.

COMMERCIAL RATES
. First 400 cubic feet or less $2.25
Next 8,600 cubic feet at 12.0 Cents per 100 cu. ft.
Next 11,000 cubic feet at 10.0 Cents per 100 cu. ft.
Next 10,000 cubic feet at 6.5 Cents per 100 cu. ft.
AllOver 30,000 cubic feet at 5.0 Cents per 100 cu. ft.
Each monthly residential bill shall be increased by the
lesser of (a) 10% of the net monthly bill or (b) $3.00, to
arrive at the gross monthly bill. Each monthly commercial bill
shall be increased by the lesser of (a) 10% of the net monthly
bill or (b) $5.00, to arrive at the gross monthly bill. The

difference between the gross rate and the net rate, represent-
ing a discount, shall be allowed for payment of bills within
ten (10) days after the date of the bill. If a gas bill is
not paid within ten (10) days after its date, the gross bill
shall apply.
The Railroad Commission of Texas, after notice and
hearing of its Docket No. 246, by its order dated December 1,
1958, established and fixed the rate to be paid at the City Gate
for gas purchased for resale to the consumers affected by this
ordinance. If such City Gate Rate is hereafter decreased or
increased by subsequent order of the Railroad Commission (and
from time to time as such orders may issue) the rate herein

fixed for Residential and Commercial use shall forthwith be
likewise adjusted by changing the price per hundred cubic feet
of each step of the above two schedules in an amount equivalent
to the change in the Gate Rate, minus or plus, as may be
appropriate.
The rates in effect hereunder shall also be adjusted by
the Company (1) so as to accomplish a decrease or increase
of such rates equivalent to the change in the amount of taxes
or other government imposition payable solely by reason of
any change in rates pursuant to the provisions of the preced-

ing paragraph; and (2) upon the imposition of any new or

increased rate of tax or similar charge imposed by any govern-
mental agency on the Company and determined or measured by the
volume, proceeds, or receipts of gas delivered to such customers,
to the extent necessary to pass the effect thereof on to such
consumers.
Such increase or decrease in rates, as appropriate,
shall be passed along by the Company to its consumers by an
adjustment in the above net monthly rates after the Company has
~i1ed with the City Clerk a sworn statement setting forth the
changes in the gate rate and/or taxes and the adjusted resi-
dential and commercial rates which result therefrom.
The rates hereinabove set out shall be effective and
applicable to distribution and sale of natural gas billed after
the effective date of this ordinance, unless and until such
rates shall be changed hereafter in accordance with law.
Section 3. The Company shall establish and post in
its office rate schedules providing monthly billing rates
complying with Section 2 of this Ordinance. The rates speci~
fied in Section 2 of this Ordinance shall be applicable to all
consumers using 150,000 cubic feet or less of gas per month.
Notwithstanding any other provision of this ordinance, the
rates for consumers using more than 150,000 cubic feet or more
in any month (hereinafter called 1I1arge volume consumersll) shall
be the rates for large volume consumers established by the
Company. Such rates shall be open to inspection by the City.
It is understood that the City Commission does not hereby
waive or relinquish any legal right or authority which the
City has or may have to fix and regulate gas rates in the
future; and all revenues received by the Company from its
large volume consumers served from the Company's distribution
system shall be taken into account in consideration by the
City Commission of any alterations in domestic rates fixed
by an ordinance of the City.

Section 4. All ordinances, resolutions, franchises,

or parts thereof in conflict herewith are hereby repealed
insofar but only insofar as such conflict exists.
Section 5. This Ordinance shall take effect and be
in force from and after its final passage and approval.
