AN ORDINANCE AMENDING CHAPTER 10, SECTION 10-4, OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, "ARSON REWARD"; DEFINING ARSON; PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS ORDINANCE SHALL BE DEE~mD GUILTY OF A MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN ANY SUM NOT MORE THAN TWO HUNDRED DOLLARS ($200.00); AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: Section 1. Section 10-4, "Arson Reward," under Chapter 10, Fire Prevention and Protection, of the Code of Ordinances of the City of La Porte, is hereby amended, and shall hereafter read as follows, to-wit: "Section 10-4. Arson Reward. . "(a) There is hereby offered to any person who shall be responsible for, or who shall furnish information leading to, the arrest and conviction of any person guilty of arson committed within the city limits, a reward in the sum of two hundred fifty dollars ($250.00). Such reward shall be paid to such person, by the city treasurer out of the general funds of the city upon proof to the city commission that such person is in fact responsible for, or has furnished information leading to, the arrest and conviction of such criminal, and after a resolution has been duly passed by the city commission finding such facts and authorizing such payment. "(b) The term 'arson' as used herein means the.wilful burning of any habitation or building. (1) 'Habitation' means a structure or vehicle that is adapted for the overnight accommodation of persons and includes: (A) each separately secured or occupied portion of the structure or vehicle; and . (B) each structure appurtenant to or connected with the structure or vehicle. (2) 'Building' means any structure or enclosure intended for use or occupation as a habitation or for some purpose of trade, manufacture, ornament, or use. liCe) The offense of arson authorizing the payment of the reward under this section shall be deemed complete when the fire has actually been communicated to a habit- ation or building, though the habitation or building is neither destroyed nor seriously injured. "(d) No officer in the employe of the city, county or state, whose duty it is to detect violations of the law or make arrests in connection therewith, shall be entitled to any reward for information leading to the arrest and conviction of any person guilty of arson." . . . . . . . Any person, as defined in Section 1.07(27), Texas Penal Code, who shall violate any provision of this ordinance, shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine not to exceed Two Hundred Dollars ($200.00). Section 3. This Ordinance shall be effective fourteen (14) days after its passage and approval. The City Clerk shall give notice of the passage of this ordinance by causing the caption hereof to be published in the official newspaper in the City of La Porte at least twice within ten (10) days after the passage of this ordinance.
