Dear Bob:
I enclose herewith for your approval, proposed draft of an
ordinance calling the City of La Porte's 1977 general elec-
tion. I would like to submit this ordinance to the La Porte
City Commission for its approval at a Workshop Meeting on
January 26, 1977, and thereafter to be formally passed and
approved at the City Commission's regular ~eeting of
February 7, 1977.
In preparing the ordinance, I have used the polling places
and election officials which you used at your recent bond
election. If there are any changes in election officials,
please let me know.
In addition, would you please present to your Board of
Trustees, for approval at the meeting at which it calls its
election, the following motion:
"Upon the motion of Trustee ,
seconded by Trustee , that
the appointed officials heretofore appointed to
conduct the La Porte Independent School District
Trustee election, will also be allowed to conduct
the City official election for the City of La Porte
on April 2, 1977, and a run-off election, if neces-
sary, on April 23, 1977.11

AN ORDINANCE CALLING THE REGULAR ANNUAL ELECTION OF THE CITY
OF LA PORTE; CALLING A RUN-OFF ELECTION, IF NECESSARY; DESIG-
NATING ELECTION PRECINCTS AND POLLING PLACES; PROVIDING FOR
THE USE OF VOTING MACHINES; APPOINTING ELECTION OFFICIALS;
PROVIDING FOR METHOD AND DATES OF ABSENTEE VOTING; PROVIDING
. FOR RETURN AND CANVASS OF VOTES OF SAID ELECTION; PROVIDING
FOR NOTICE; PROVIDING FOR FILING DEADLINE AND FILING FEES FOR
CANDIDATES; PROVIDING FOR THE HOLDING OF A JOINT ELECTION
WITH THE LA PORTE INDEPENDENT SCHOOL DISTRICT; PROVIDING A
SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY CO~iISSION OF THE CITY OF LA PORTE:
Section 1. An election shall be held within the corporate
limits of the City of La Porte, Texas, on the 2nd day of April,
1977, such day being the first Saturday in April, 1977, between
seven o'clock (7:00) A.M.. and seven o'clock (7:00) P.M., for
~ the purpose of electing a Commissioner of said City for Position
No.1, and a Conwissioner of said City for Position No.3. A
run-off.election, if necessary, shall be held on April 23, 1977,
between the same hours. Said election, and said run-off election,
if necessary, shall be held in conjunction with a Trustee's
election to be held on the same date(s) by the La Porte
Independent School District, and the appointed officials who
shall be appointed to conduct the La Porte Independent School
District election, will also be allowed to conduct the City

official election for the City of La Porte.
Section 2. , Said election shall be held at each of the
following voting places within said City, and the following
named persons are hereby appointed as officers of said election,
to-wit:
Election Precinct No. l: All voters living in such
Precinct No. 1 (consisting of that portion of the City of
La Porte which is located east and north of the Southern Pacific
Railroad) shall vote at the La Porte High School Auditorium,
which is located at Park and "J" Street, in the City of La Porte,
Texas, with the following election officers:

Election Precinct No.2: All voters living in such
Precinct No. 2 (consisting of that portion of the City of
La Porte which is located west and south of the Southern
Pacific Railroad) shall vote at the Baker School Cafetorium,
which is located at Spencer Highway and Underwood Road,
La Porte, Texas, with the following election officials~
Mrs. Margaret Moorman, Presiding Judge
Mrs. Betty Schultz, Alternate Presiding Judge
The Presiding Judge at each of the above specified polling
places shall appoint as many clerks as he or she deems neces-
sary for the proper conduct of said election at said polling
place, provided that at least two clerks shall be appointed
in each case.
Section 3. Voting at said election, including absentee
voting, shall be by the use of voting machines, and the
ballots of said elections shall conform to the Texas Election
Code, as amended.
Absentee voting shall be conducted by a clerk for absentee
voting, namely, Robert H. Williams, Jr., and the place at which
the absentee voting shall be conducted is d~signated as the
Administration Building, La Porte Independent School District,
301 East Ave. "J", La Porte, Texas, to which address ballot
applications and ballots voted by mail may be mailed. Said
clerk shall keep said office open for absentee voting during
his regular working hours and in any event for at least 8 hours
on each day which is not a Saturday, a Sunday, or an official
State holiday.
Section 4. That all election materials including notice
of the election, ballots, instruction cards, affidavits and
other forms which voters may be required to sign and all
absentee voting materials shall be printed in both English
and Spanish, or Spanish translations thereof shall be made

available in the circumstances permitted and in the manner
required by law.
Section 5. The City Clerk of the City of La Porte shall
forthwith issue Notice of'said election by causing a substantial
copy of this Ordinance to be published one time in the BAYSHORE
SUN, which is hereby found and declared to be a newspaper of
general circulation in said City, not less than ten days nor
more than thirty days prior to the date of the said election.
Section 6. Upon a candidate tendering his application on
the form prescribed, the City Clerk shall furnish to such candi-
date all information relative to the qualifications for the
.~. office being sought; the method of placing the candidate's name
on the ballot; the amount of the required filing fee;. and any
other pertinent information concerning said election.
Section 7. The deadline for a candidate to make applica-
tion to have his name appear upon the ballot for such election,
is hereby designated and established as 5:00 o'clock P.M.,
Wednesday, March 2, 1977. The filing fee for each candidate for
the office of Commissioner is hereby established at Fifty Dollars
($50.00). The filing fees shall be used to d~fray the cost of
the election, and said fees shall be prorated and any surplus

shall be refunded to said candidates. As an alternative to
paying a filing fee, a candidate may obtain a place on the
ballot by filing' a petition as provided for in City of La Porte
Ordinance No. 968, passed and approved October 1, 1973, codified
as Section 9-3 of the Code of Ordinances of the City of La Porte.
Section 8. Said election shall be held in accordance with
the provisions of the City Charter of the City of La Porte, and
the general election laws of the State of Texas governing
general and municipal elections, so far as same may be applicable
thereto.

Section 9. Immediately after said election, the officers
holding the same shall make and deliver the returns of the
results thereof and the accompanying records for use in the
official canvass to the City Commission of the City of La Porte,
and the City Commission shall canvass said returns at the
earliest practicable time, and shall, immediately after can-
vassing the returns, declare the results of the election. The
Mayor shall immediately thereafter deliver to the candidate
for whom the majority of votes has 'been polled for each
respective office, a certificate of election. Such elected
officials shall assume their duties within ten (10) days
thereafter, Sundays excluded, upon their taking the oath of
office.
Section 10. The City Commission of the City of La Porte
hereby authorizes reimbursement to the La Porte Independent
School District, for one-half (1/2,) of the common expenses
of the joint election(s).
Section 11. Each and every provision, paragraph, sen-
tence and clause of this Ordinance has been separately con-
sidered and passed by the City Commission of the City of
La Porte, Texas, and each said provision .would have been
separately passed without any other provision, and if any
provision hereof shall be ineffective, invalid or unconstitu-
tional, for any cause, it shall not impair or affect the
remaining portion, or any part thereof, but the valid portion
shall be in force just as if it had been passed alone.
Section 12. This Ordinance shall be in effect immediately
upon its passage and approval.

delestado de Tejas.

demo;a noticia de dicha eleccio~ por causar que aparezca una 'parte
substantial deesta ordenanza en el BAYSHORE SUN, 10 cJ~l es
debidamente hallado y declarado .'.el periodico de circulac'i<:>r: gene~al'
de esta ciudad, en no menos de 10 dias ni en no m~s de 30'dias
antes de la fecha de dicha eleccion.
Secci~n 6. Al dar un candidato su aplicaciod en la forma
correcta" e1 dependiente municipal t~ene que dar a tal candidato
toda la informaciort ~n. cuanto alas calificaciones de la oficina
deseada; el metodo de poner el nombre del candidato en la boleta,
el costo para aplicar por la bficina; y cualquier otra informacio~
tocante a dicha eleccio~.
Secci~n 7. La ultima hora para la cual un candidato pueda
aplicar para que aparezca su nombre sobre las boletas de tal
eleccio~ es las 5 de la tarde, miJrcoles, el 2 de marzo, 1977.
El honorario para cada candi~ato para la posicioA de comisario
es debidarnente declarado ser cincuenta dolares ($50.00). Este

honorario, 0 sea costo, se usara para disminuir el costo de la
eleccion, y dichos costos de los candi9atos se cuotizar~n y si
,
se qu~da algo, esto se devolvera a los candidatos. En vez de
pagar honorarios, un candidato puede obtener un lugar sobre
la boleta por dar una peticio~ como provisto en la ordenanza
municipal de La Porte nu. 968, pasada y aprobada el primer dia
de octubre, 1973, codificada como la seccion 9-3 del codigo de
ordenanzas de la ciudad de La Porte.
Secc.idn 8. Dicha eleccion se celebrara de acuerdo con las
provisiones 'de la carta municipal de La Porte, y con las leyes
generaleselectorales del estado de Tejas que gobiernan las
elecciones generales y municipales.

Se'cc:ion 9: Inmediamente despues de dicha eleccion, los
oficiales 0 jueces entregar~n los resultados y las copias
oficiales a la comision.municipal de La Porte para que ~sta los
pueda contar y verificar~

La comisi9n tiene qu~ co~tar los
resultados tan. pronto posible, y entonces, sin demora ninguna,

declarar los resultados oficiales de la eleccion. Entonces el
alcalde inmediatamente entregara al candidato recibiendo una

mayoria de los votos un certificado de eleccion. Los nuevos
eligidos tomaran sus lugares dentro de 10 dias, no inclusive
los domingos, al prestar jurarne~to de sus posiciones.
Seccioh 10: La comisio~ municipal de La Porte da'permiso
para un reembolso al distrito escolar de La Porte para la mit~d
(1/2) de los gastos comunes de las elecc~ones mixtas.

Seccion 12: Esta ordenanza esta en efecto inmediatamente
al ser pasada y aprobada.
