<br />. <br /> <br />. <br /> <br />ORDINANCE NO. <br /> <br />1555 <br /> <br />AN ORDINANCE AUTHORIZING THE MUNICIPAL COURT TO COLLECT A SPECIAL <br />EXPENSE FOR SERVICES PERFORMED ON DISMISSED CASES; FINDING COMPLIANCE <br />WITH THE OPEN MEETINGS LAW; AND PROVIDING FOR TH.E EFFECTIVE DATE HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br /> <br />Section 1. Pursuant to the provisions of Article 45.06, Texas <br /> <br />Code of Criminal Procedure, the City Council of the City of La Porte <br /> <br />hereby authorizes the City of La Porte Municipal Court to collect a <br /> <br />special expense for services performed in cases in which the laws of <br /> <br />this State require that the case be dismissed because of actions by <br /> <br />or on behalf of the defendant which were subsequent to the date of <br /> <br />the alleged offense. Such actions are limited to compliance with the <br /> <br />provisions of Subsection (a), Section l43A, Uniform Act Regulating <br />Traffic on Highways (Article 670ld, Vernon's Texas Civil Statutes). <br /> <br />The City Council of the City of La Porte finds that the actual expenses <br /> <br />incurred for the services in such cases is in excess of $10.00, and <br /> <br />the Municipal Court is authorized to collect a special expense of <br /> <br />$10.00 in each such case. <br /> <br />Section 2. The special expense may be collected for offenses <br /> <br />committed on or after September 1, 1987. <br /> <br />Section 3: The City Council officially finds, determines, re- <br /> <br />cites and declares that a sufficient written notice of the date, <br /> <br />hour, place and subject of this meeting of the City Council was posted <br /> <br />at a place convenient to the public at the City Hall of the City for <br /> <br />the time required by law preceding this meeting, as required by the <br /> <br />Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes <br /> <br />Annotated; and that this meeting has been open to the public as <br /> <br />required by law at all times during which this Ordinance and the <br /> <br />subject matter thereof has been discussed, considered and formally <br /> <br />acted upon. The City Council further ratifies, approves and confirms <br /> <br />such written notice and the contents and posting thereof. <br />Section 3: This Ordinance shall take effect September 1, 1987. <br />
