ORDINANCE NO. l538
AN ORDINANCE VACATING, ABANDONING AND CLOSING A 0.0480 ACRE TRACT
OF LAND, BEING ALL OF A l.OO FOOT RESERVE LYING WEST OF AND ADJACENT
TO THE WEST LINE OF LUELLA BLVD (75FT. RIGHT-OF-WAY), IN THE CITY
OF LA PORTE: FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW: AND
PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, the Ci ty Council of the City of La Porte has been
requested by the record owner of all of the property abutting portions
of certain streets and alley, described on Exhibit "A", attached
hereto and fully incorporated by references herein: and
WHEREAS, the City Council of the City of La Porte has determined,
and does hereby find, determine and declare that the hereinafter
described rights-of-way are not suitable, needed, or beneficial to
the public as public alleys, roads or streets, and that the closing
of the hereinafter described portions of said rights-of-way is for
the protection of the public and for the public interest and benefit,
and that the hereinafter described portions of said rights-of-way
should be vacated, abandoned, and permanently closed.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF LA PORTE:
Section I. Under and by virtue of the power granted to the City
of La Porte under its Horne Rule Charter and Chap. 13, Title 28, Art.
ll75, of the Revised Civil Statutes of the State of Texas, 1925, the
hereinafter described rights-of-way lying wholly within the boundaries
of the City of La Porte are hereby permanently vacated, abandoned,
and closed by the City of La Porte, to-wit:
That certain 0.0480 acre tract of land being all of
a 1.00 foot reserve lying West of and adjacent to
the West line of Luella Boulevard (75 foot Right-of-
Way), as shown on the Brookglen Street Dedication
Plat according to the map or plat thereof recorded
in Volume 198, Page 76 of the Map records of Harris
County, Texas, as more fully described in Exhibit
"A" attached hereto, incorporated by reference here-
in, and made a part hereof for all purposes.

Section 2. This ordinance is passed and approved by the City
Council of the City of La Porte, at the request of the San Jacinto
Junior College District, for the expansion of its campus, and all
applicable fees and charges are waived by the City of La Porte.
Section 3. The City Council officially finds, determines, re-
cites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was posted
at a place convenient to the public at the City Hall of the City for
the time required by law preceding this meeting, as requried by the
Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes
Annotated: and that this meeting has been open to the public as
required by law at all times during which this ordinance and the
subject matter thereof has been discussed, considered and formally
acted upon. The City Council further ratifies, approves and confirms
such written notice and the contents and posting thereof.
Section 4. This Ordinance shall take effect and be in force
from and after its passage and approval.

DESCRIPTION
Of a 0.0480 acre tract of land being all of a 1.00 foot Reserve
lying West of and adjacent to the West line of Luella Boulevard
(75 foot Right-Of-Way), as shown on the Brookglen Street
Dedication Plat according to a map or plat thereof recorded in
Volume 198, Page 76 of the Map Records of Harris County, Texas,
said 1.00 foot strip also being the East 1.00 foot of an 18.6459
acre tract of land indicated as an acreage tract on said
Dedication plat, said 0.0480 acre tract being more particularly
described by metes and bounds as follows:
BEGINNING at a 5/8 inch iron rod found for the most Southerly
setback corner at the Southwest intersection of th~ South Right-
Of-Way line of Spencer Highway (100 foot Right-Of-Way), and the
West Right-Of-Way line of said Luella Boulevard;
THENCE South 02058'54" East a distance of 689.88 feet, along said
Westerly line o~ Luella Boulevard to a 1/2 inch iron rod found
for the beginning of a curve;
THENCE in a Southwesterly direction with a curve to the right,
having a radius of 962.50 feet, ~ central angle of 26015'00" and
an arc distance of 440.97 feet to a 1/2 inch iron rod found for a
point of tangency on the said West line of Luella Boulevard;

THENCE South 23016'06" West a distance of 270.47 feet to a 5/8
inch iron rod found for the beginning of a curve;
THENCE in a Southwesterly direction with a curve to the left,
having a radius of 1,037.50 fee:t;, a central angle of 26015'00"
and an arc distance of 475.0Q feet to a 5/8 inch iron rod found
for point of tangency on the said Westerly Right-Of-Way line of
Luella Boulevard;
THENCE South 02058'54" East I:ontinuing with said West line of
Luella Boulevard, at a distance of 5.12 feet passing a 1/2 inch
iron rod found for the Northeast corner of a 0.2702 acre tract of
land conveyed to San Jacinto Junior College District as described
in an instrument filed under Harris County Clerk's File No.
H452408, Harris County, Texas, at 65.12 feet passi~g a 1/2 inch
iron rod found for the Southeast corn~r of said 0.2702 acre
tract, and continuing in all a total distance of 213.42 feet to a
1/2 inch iron rod found for the Southeast CDrner of said 18.6459
acre tract;
THENCE South 86056'00" West along the South line of said 18.6459
acre tract, a distance of 1.00 foot to a point for corner;
THENCE 1.00 foot West of and parallel to the West Right-Of-Way of
said Luella Boulevard, the following calls;
North 02058'54" West at 148.30 feet passing the SCluth line
of said 0.2702 acre tract, at 208.30 feet passing the North
line of said 0.2702 acre tract, and continuing for a total
distance,of 213.42 feet'to a point for curve to the right;
