HomeMy WebLinkAboutO-1987-1530 -- e ORDINANCE NO. 1530 AN ORDINANCE VACATING, ABANDONING AND CLOSING PORTIONS OF CERTAIN STREETS AND ALLEYS IN THE TOWN OF LA PORTE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. WHEREAS, the City Council of the City of La Porte has been requested by the record owner of all of the property abutting portions of certain streets and alley, described on Exhibit IIAII, attached hereto and fully incorporated by references herein; and WHEREAS, the City Council of the City of La Porte has determined, and does hereby find, determine and declare that the hereinafter described rights-of-way are not suitable, needed, or beneficial to the public as public alleys, roads or streets, and that the closing of the hereinafter described portions of said rights-of-way is for the protection of the public and for the public interest and benefit, and that the hereinafter described portions of said rights-of-way should be vacated, abandoned, and permanently closed. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section I. Under and by virtue of the power granted to the City of La Porte under its Home Rule Charter and Chap. 13, Title 28, Art. 1175, of the Revised Civil Statutes of the State of Texas, 1925, the hereinafter described rights-of-way lying wholly within the boundaries of the City of La Porte are hereby permanently vacated, abandoned, and closed by the City of La Porte, to-wit: TRACT ONE: That portion of the right-of-way of South 7th Street, extending from the South right-of-way of South S street, to the South right-of-way of South T Street, and being that portion of the right of way of South 7th Street lying and being situated between Block 1267 and Block l268, Town of La Porte, Harris County, Texas, and containing 28,800 square feet. TRACT TWO: -That portion of the right-of-way of South T Street, being 80 foot in width, being adjacent to the south boundary line of Block 1267, Town of La Porte, Harris County, Texas, and extending from the east right-of- way line of South 7th Street, to the west right-of-way Revised 2-23-87 e e Ordinance No. 1530, Page 2 line of South 6th Street, and containing 21,280 square feet. TRACT THREE That portion of the right-of-way of 12th Street, ly- ing and being situated between Blocks 1146 and 1147, Town of La Porte, Harris County, Texas, and extend- ing from the south right-of-way line of South IILII street, to the north right-of-way line of South "M" Street, and containing 24,000 square feet. SAVE AND EXCEPT a sixteen foot (16') utility easement retained by the City of La Porte, centered on an exist- ing twelve inch (1211) water line. TRACT FOUR: The alleys in Block 1260, 1261, 1267 and 1147, all in the Town of La Porte, Harris County, Texas. TRACT FIVE: That portion of the right-of-way of Park Avenue which remains unclosed, being 0.35 acrse, more or less, more particularly described by metes and bounds attached hereto as Exhibit IIAII, incorporated by reference here- in and made a part hereof for all purposes. TRACT SIX: That portion of the right-of-way of South T Street, being 80 foot in width, being adjacent to the South boundary line of Block 1261, Town of La Porte, Harris County, Texas, and the North Boundary line of Block 1296, Town of La Porte, Harris County, Texas, and extending from the West right-of-way line of south Broadway Street, to the East right-of-way line of South 1st Street, and being a tract of land 266' x 80', and containing 21,280 square feet. Section 2. The City Council officially finds, determines, re- cites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as requried by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as e e Ordinance No. 1530, Page 3 required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 3. This Ordinance shall take effect and be in force from and after its passage and approval. PASSED AND APPROVED this the 23rd day of February, 1987. Page 311; a distance of 125.00 feet to the Southwest corner of this 0.059 acre tract and the POINT OF BEGINNING. Thence, N 00 00' 36" W; coincident with the East boundary line of Lots 16, 15, 14. 13. 12. 11 and 10; a distartce of 159.95 feet to the Northwest corner of this 0.059 acre tract.
