ORDINANCE NO. 1392
AN ORDINANCE DECLARING THE INTENTION OF THE CITY OF LA PORTE
TO INSTITUTE PROCEEDINGS TO ANNEX CERTAIN TERRITORY 1 CALLING
TWO (2) PUBLIC HEARINGS AT WHICH ALL INTERESTED PARTIES SHALL
HAVE AN OPPORTUNITY TO BE HEARD: PROVIDING FOR THE PUBLICATION
OF NOTICE OF SUCH HEARINGS BY THE PUBLICATION OF THIS ORDINANCE 1
AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council of the City of La Porte hereby
declares its intention to institute annexation proceedings, to
annex the following described terri tory to the City of La Porte
by the passage of an ordinance of annexation extending the gen-
. eral corporate limits of the City of La Porte for all purposes
to include within such territory all of the following described
territory now situated within the exclusive extraterritorial
jurisdiction of the City of La Porte. As used herein, the term
extraterritorial jurisdiction shall have the same meaning ascribed
to it as is ascribed to it in the Municipal Annexation Act of
1963, compiled as Article 970a, Vernon's Annotated Texas Statutes:
Boundaries of a tract of land comprising the Spenwick Place
Municipal utility District 1 the College View Municipal utili ty
District; the acreage lying between said districts: and portions
of the rights-of-way of Fairmont Parkway and Spencer HighwaY1
all in Harris County, Texas.

BEGINNING at the point in the present ci ty limit line of
the Ci ty of La Porte, said point being the intersection of the
Easterly right-of-way line of Underwood Road and the Northerly
right-of-way line of Spencer Highway, also known as West Main
Street, in the City of La Porte:
THENCE, Westerly along the said Northerly right-of-way line
of Spencer Highway, also known as West Main Street, to its
point of intersection with the Westerly right-of-way line of
Underwood Road:
THENCE, continuing in a Westerly direction along the Northerly
right-of-way of said Spencer Highway, also known as West Main
Street, to a point which is the Northerly extension of the
Easterly property line of the 141 acre San Jacinto College
tract:

THENCE, Southerly along the said Northerly extension and the
Easterly property line of the said 141 acre San Jacinto College
tract, and its Southerly extension, to its point of intersection
with the Sout.herly right-of-way line of Fairmont parkway:
THENCE, Easterly along the Southerly right-of-way line of
said Fairmont Parkway, following its curves, to its point of
intersection with the Easterly right-of-way line of Underwood
Road;

THENCE, Northerly along the said Easterly right-of-way line
of Underwood Road, to the point of beginning.
Section 2. The City Council of the City of La Porte hereby
directs the City Manager and City Departments to prepare a proposed
Service Plan that provides for the extension of municipal services
into each area to be annexed. The proposed Service Plan shall be
made available for inspection and explained to the inhabitants of
the area to be annexed at the public hearing.

Section 3. The City Council of the City of La Porte hereby
calls two (2) public hearings at which all interested persons
shall have an opportunity to be heard upon such proposal to
annex the territory described above, which two (2) public hear-
ings shall be held as follows, to-wit:
(I) In the City Council Chambers, City Hall, 604 W. Fairmont
Parkway, La Porte, Texas, at seven o'clock P.M., on the
5th day of December, 1983~ and
(2) In the College View Municipal utility District Offices
at 8610 Bandridge, La Porte, Texas, at eight-thirty
o'clock P.M., on the 5th day of December, 1983.

Section 4. The annexation proceeding of which notice of
intention to annex is given by this Ordinance shall be instituted
not less than twenty (20) days nor more than forty (40) days sub-
sequent to such pUblic hearing.
Section 5. The City Secretary of the City of La Porte is
hereby direc:ted to cause notice of such public hearing to be
given by pUblication of this Ordinance in The Bayshore Sun, a
newspaper having general circulation in the City of La Porte and
in the territory proposed to be annexed, such publication to be
made at least once, not more than twenty (20) days nor less than

ten (10) days prior to the date of such public hearing. Addi-
tional notice by certified mail should be given to railroad
companies then serving the city and on the city's tax roll where

the right-of--way thereof is included in the territory to be
annexed.
Section 6. The City Council officially finds, determines,
recites and declares that a sufficient written notice of the
date, hour, place and subject of this meeting of the City Council
was posted at a place convenient to the public at the City Hall
of the City for the time required by law preceding this meeting,
as required by the Open Meetings Law, Article 6252-17, Texas
Revised Civil Statutes Annotated; and that this meeting has been
open to the public as required by law at all times during which
this ordinance and the subject matter thereof has been discussed,
considered and formally acted upon.
The Ci ty Council further
ratifies, approves and confirms such written notice and the
contents and posting thereof.
Section 7. This Ordinance shall be effective immediately
upon its passage and approval.
