ORDINANCE NO. 1385
AN ORDINANCE DECLARING THE INTENTION OF THE CITY OF LA PORTE TO
INSTITUTE PROCEEDINGS TO ANNEX CERTAIN TERRITORY1 CALLING A PUBLIC
HEARING AT WHICH ALL INTERESTED PARTIES SHALL HAVE AN OPPORTUNITY
TO BE HEARD 1 PROVIDING FOR THE PUBLICATION OF NOTICE OF SUCH HEAR-
ING BY THE PUBLICATION OF THIS ORDINANCE 1 FINDING COMPLIANCE WITH
THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1.
The City Council of the City of La Porte hereby
declares its intention to institute annexation proceedings, to
annex the follo1i/ing described territory to the City of La Porte by
the passage of an ordinance of annexation extending the general
corporate limits of the City of La Porte for all purposes to include
within such territory all of the following described territory now
situated within the exclusive extraterritorial jurisdiction of
the City of La Porte. As used herein, the term extraterritorial
jurisdiction shall have the same me.aning ascribed to it as is
ascribed to 'it in the Municipal Annexation Act of 1963, compiled
as Article 970a, Vernon's Annotated Texas Statutes:
Boundaries of a tract of land comprlslng the Spenwick
Place Munic ipal utility District 1 the College View Municipal
Ut ili ty District 1 the acreage lying between said districts 1
and portions of the rights-of-way of Fairmqnt Parkway and
Spencer HighwaY1 all in Harris County, Texas.
BEGINNING at the point in the present city limit line
of the City of La Porte, said point being the intersection
of the Easterly right-of-way line of Underwood Road and
the Northerly right-of-way line of Spencer Highway, also
known as West Main Street, in the City of La Porte1
THENCE, Westerly along the said Northerly right-of-way
line of Spencer Highway, also known as West Main Street,
to its point of intersection wi th the Westerly right-of-way
line of Underwood Road1
THENCE:, continuing in
Northerly right-of-way of
as West MClin Street, to
extension of the Easterly
San Jacinto College tract1
a Westerly direction along the
said Spencer Highway, also known
a point which is the Northerly

THENCE, Southerly along the said Northerly extension
and the Easterly property line of the said 141 acre San
Jacinto College tract, and its Southerly extension, to its
point of intersection with the Southerly right-of-way line
of Fairmont Parkway;

THENCE, Northerly along the said Easterly right-of-way
line of Underwood Road, to the point of beginning.
Section 2.
The City Council of the City of La Porte hereby
4It directs the City Manager and City Departments to prepare a proposed
Service Plan that provides for the extension of municipal services
into each area to be annexed. The proposed Service Plan shall be
made available for inspection and explained to the inhabi tants of
the area to be annexed at the public hearing.
Section 3.
The City Council of the City of La Porte hereby
calls a public hearing at which all interested persons shall have
an opportunity to be heard upon such proposal to annex the terri-
tory described above, which hearing shall be held in the City
Council Chambers, City Hall, 604 W. Fairmont Parkway, La Porte,

Texas, at seven o'clock P. M. on the 9th day of November, 1983.
Section 4..
The annexation proceeding of which notice of
intention to annex is given by this Ordinance shall be instituted
not less than twe nty (20) days nor more than forty (40) days sub-
sequent to such public hearing.
Section 5..
The City Secretary of the City of La Porte is
hereby directed to cause notice of such public hearing to be given
by publication of this Ordinance in The Bayshore Sun, a newspaper
having general circulation in the City of La Porte and in the
terri tory proposed to be annexed, such publication to be made at
least once, not more than twenty (20) days nor less than ten (10)

by certified mail should be given to railroad companies then ser-
ving the city and on the city's tax roll where the right-of-way
thereof is included in the territory to be annexed.
Section 6.
The City Council officially finds, determines,
recites and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
Ci ty for the t i.me required by law preceding this meeting, as re-
e quired by the Open Meetings Law, Article 6252-17, Texas Revised
Civil Statutes Annotated 1 and that this meeting has been open to
the public as required by law at all times during which this ord-
inance and the subject matter thereof have been discussed, consi-
dered and formally acted upon. The City Council further ratifies,
approves and confirms such written notice and the contents and
posting thereof"
Section 7.
This Ordinance shall be effective immediately
upon its passage and approval.
