ORDINANCE NO. 1374
AN ORDINANCE VACATING, ABANDONING AND CLOSING ALL OF THE ALLEY
IN BLOCK ELE:VEN HUNDRED TWENTY-THREE ( 1123), IN THE TOWN OF
LA PORTE, HARRIS COUNTY, TEXAS.
WHEREAS, the said alley in Block Eleven Hundred Twenty-three
(1123) of the Town of La Porte has never been opened or used as
a public thoroughfare, and the public utilities now making use
of such alley have all given their written consent for its
closing: and
WHEREAS, the City Council of the City of La Porte has
determined and does hereby find, determine and declare tha t

the said alley is not sui table, needed, or benef icial to the
public as a public alley, and should be vacated, abandoned and
permanently closed~
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF LA PORTE:
Section 1. The alley located in Block Eleven Hundred
Twenty-three (ll2 3) of the TOWN OF LA PORTE, Harris County,
Te xas, is hereby permanently vacated, abandoned and closed by
the City of La Porte.

Section 2. The City Council officially finds, deter-
mines, recites and declares that a sufficient written notice
of the date, hour, place and subject of this meeting of the
Ci ty Counci 1 was posted at a place convenient to the publ ic
a t the Ci ty Ha II of the Ci ty for the time required by law
preceding this meeting, as required by the Open Meetings law,
Article 6252-17, Texas Revised Civil Statutes Annotated; and
that this meeting has been open to the public as required by
law at all times during which this ordinance and the subject
matter thereof has been discussed, considered and formally
acted upon. The Ci ty Council further ratif ies, approves and
~., confirms such written notice and the contents and posting
thereof.

Section 3. Th is Ordinance shall take effect and be in
force from and after its passage and approval.

Re: Alley in Block 1l23, Town of La Porte,
Harris County, Texas
Gentlemen:
For and in consideration of the permanent vacating, abandoning, and
closing of the alley in Block ll23, Town of La Porte, Harris County,
Texas, by the City Council of the City of La Porte, this letter will
evidence my agreement, as owner, that I understand that the City of
La Porte has abandoned, and capped each end, of a sanitary sewer
line which was located in the said alley in Block ll23, Town of
La Porte, Harris County, Texas.
I further understand that the Ci ty of La Porte will not remove said
line from said alley, and that the City of La Porte assumes no respon-
sibility for said line after September 7, 1983, and I agree to save
and hold harmless the City of La Porte from any loss, claim, or lia-
bili ty, arising from the abandonment of said sewer line in the alley
in Block l123, Town of La Porte, Harris County, Texas.
