<br />. <br /> <br />. <br /> <br />RESOLUTZON NO. 96-~ <br /> <br />A RESOLUTION ESTABLISHING THE POLZCY 01' THE CITY COUNCIL 01' THB <br />CITY OF LA PORTE CONCERNING AN AGREEMENT WITH SOUTHERN PACIPIC <br />TRANSPORTATION COMPANY; PZNDING COMPLZANCE WITH THE OPEN MEETINGS <br />LAW; AND PROVIDING AN EPPECTIVE DATE HEREOP. <br /> <br />BE IT RESOLVED BY THE CZTY COUNCIL 01' THE CITY 01' LA PORTE: <br /> <br />Section 1. <br /> <br />The City of La Porte (hereinafter "City") and <br /> <br />Southern Pacific Transportation Company, a Delaware corporation <br /> <br />(hereinafter liS. P. ") are currently in negotiations for an Agreement <br /> <br />concerning S.P.'s 219 acre tract in the City of La Porte. A true <br /> <br />and correct copy of a discussion draft of said Agreement is <br />attached to this Resolution as Exhibit "A" , incorporated by <br /> <br />reference herein, and made a part hereof for all purposes. <br />section 2. The City Council of the City of La Porte, by the <br /> <br />passage of this Resolution, expresses its policy and the sense of <br />the City Council, that an ordinance approving the final version of <br /> <br />an Agreement in substantially the form of the discussion draft of <br /> <br />Agreement attached hereto as Exhibit "A", incorporated by reference <br /> <br />herein, and made a part hereof for all purposes, shall be passed <br />and approved by the City Council of the City of La Porte upon <br />completion of negotiations between representatives of City and <br /> <br />S.P., of a final version of said Agreement, and completion of <br /> <br />survey and supporting documentation. <br />section 3. The City Council officially finds, determines, <br /> <br />recites, and declares that a sufficient written notice of the date, <br /> <br />hour, place and subject of this meeting of the City Council was <br />posted at a place convenient to the public at the City Hall of the <br />ci ty for the time required by law preceding this meeting, as <br />required by the Open Meetings Law, Chapter 551, Texas Government <br />Code; and that this meeting has been open to the public as required <br />
