<br />e <br /> <br />. <br /> <br />RESOLUTION NO. 94-08 <br /> <br />A RESOLUTION AUTHORIZING THE CITY 01' LA PORTE, TEXAS, TO JOIN IN THE <br />pORHATION AND OPERATION 01' A COALITION 01' CITIES CONCERNING THE <br />ELECTRIC RATES OF HOUSTON LIGHTING AND POWER COMPANY; AUTHORIZING <br />SUCH COALITION TO INTBRVEn ON BEBALp 01' THE CITY OF LA PORTE IN <br />PUBLIC UTILITY COIIKISSION DOCKET NO. 12065 AND TO TAKE OTHER <br />APPROPRIATE ACTIONS RELATING TO ELECTRIC UTILITY RATES; MAKING <br />CERTAIN pINDINGS AND TAKING OTHER ACTIONS RELATING THERETO; FINDING <br />COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE <br />DATE HEREOp. <br /> <br />WHEREAS, the City of La Porte (the 'City") is authorized under <br />the terms of the Texas Public utility Act, Art. 1446c, Tex. Rev. <br />Civ. Stat. Ann. (Vernon Supp. 1994), and Chapter 37 of the Code of <br />Ordinances of the City, to regulate electric rates within the city <br />to the extent provided therein; and <br /> <br />WHEREAS, certain parties have instituted with the Public <br />utility commission of Texas (the "Commission") a rate proceeding <br />styled "Complaint of Kenneth D. Williams against Houston Lighting <br />and Power Company ("HL&P") for certain unincorporated areas wi thin <br />its service area; and <br /> <br />WHEREAS, certain municipalities have indicated their desire to <br />join with the City in a coalition of cities interested in the <br />conduct of the Proceeding and to intervene on behalf of the <br />participating municipalities therein; and <br /> <br />WHEREAS, the City Council of ,City has determined that it is in <br />the best interests of the electric rate payers of the City that the <br />City join in the formation and operation of the Coalition, and that <br />the coalition be authorized to l.ntervene in the Proceeding on the <br />City'S behalf; <br /> <br />NOW, THEREFORE,' BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LA PORTE: <br /> <br />Section 1. The facts and recitation set forth in the preamble <br />of this Resolution are hereby found to be true and correct. <br />Section 2. The City is hereby authorized to assist in the <br />organization of and to join in a coalition of municipalities and <br />other parties having a similar interest in the Proceeding. The City <br />is hereby authorized to intervene in the proceeding, either as a <br />member of the coalition or otherwise, and to take all related legal <br />and other actions on behalf of the City and its rate payers in <br />connection with the subject matter thereof. <br />Section 3. Robert T. Herrera, City Manager, or any other <br />officer or agent of the City designated by the City Council for such <br />purpose, is hereby authorized to take all actions necessary to <br />represent the City in the conduct and operations of the coalition <br />
