<br />e <br /> <br />e <br /> <br />RESOLUTION NO. 93- lS <br /> <br />A RESOLUTION 01' THE CITY COUNCIL 01' THE CITY OF LA PORTE, MAKING <br />CERTAIN FINDINGS OF FACT, AND DETERMINING THE POLICY OF THE CITY <br />OF LA PORTE, IN CONNECTION WITH THE SALB OF THAT PORTION OF LITTLE <br />CEDAR BAYOU PARK SITUATED EAST 01' OLD HIGHWAY 146, AND THB <br />ACQUISITION 01' THE FORKER SEABREEZE SAILING CLUB PROPERTY; FINDING <br />COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFpECTIVE <br />DATE HEREOF. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL 01' THB CITY 01' LA PORTE; <br /> <br />Section 1. <br /> <br />The City Council of the City of La Porte, in <br /> <br />connection with that portion of Little Cedar Bayou Park situated <br />east of Old Highway 146, finds, determines and declares the <br /> <br />following: <br /> <br />1. This portion of Little Cedar Bayou Park has not been used <br />by the public in a manner which had been anticipated by <br />the City. It has been projected that less than 100 <br />people visit this portion of Little Cedar Bayou Park, on <br />a yearly basis. <br /> <br />2. This portion of Little Cedar Bayou Park has the following <br />problems: <br /> <br />a) erosion - 12' per year due to tidal flow, surges of <br />ships, and storms; <br />b) security - property is limited to walking and is <br />densely wooded; <br />c) homeless have been known to visit the site and take <br />up temporary residence; <br />d) vandalism of fixed assets, boardwalks and viewing <br />areas are pillaged for wood; and <br />e) access from main park property requires citizens to <br />cross Old Highway 146, which is hazardous. <br /> <br />3. This portion of Little Cedar Bayou Park has been <br />appraised at $385,000.00, in its present condition, and <br />will require expenditure of $160,000.00 to prevent the <br />erosion of further park land. <br /> <br />4. The highest and best use of this portion of Little Cedar <br />Bayou Park is as a nature center. <br /> <br />5. This portion of Little Cedar Bayou Park connects to the <br />larger body of Little Cedar Bayou Park complex, located <br />west of Old Highway 146, which offers many of the same <br />attributes of that portion of Little Cedar Bayou Park <br />situated east of Old Highway 146, but without the erosion <br />
