<br />. e <br /> <br />RESOLUTION NO. 89-13 <br /> <br />WHEREAS, the City of La Porte, Texas, previously retained Sears and Burns as <br /> <br />special counsel to represent its interests in litigation against the City filed by Southern <br /> <br />Ionics, Inc., and Houston Chemical Services, Inc.; and, <br /> <br />WHEREAS, the initial authority given by the City to Sears and Burns, to present <br /> <br />defenses and pursue counterclaims arising from the facts, has been questioned by Southern <br /> <br />Ionics, Inc., and Houston Chemical Services, Inc.; NOW, THEREFORE, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS: <br /> <br />The authority of the City for Sears and Burns to present those defenses and <br /> <br />counterclaims now stated, or others which may arise from the facts discovered, is <br /> <br />reaffirmed. The authority given expressly includes all matters for termination of the <br />Industrial District Agreement between the City and Southern Ionics, Inc., and notice thereof. <br /> <br />Sears and Burns is authorized to do all acts necessary to effect the City's <br /> <br />intention as stated herein and to defend it or seek relief as may, in that firm's opinion, be <br /> <br />necessary. <br /> <br />RESOLVED this 11th day of September, 1989. <br /> <br /> <br />~~A~ <br /> <br />Norman Malone, Mayor <br /> <br />ATTEST: <br /> <br />~~ <br /> <br />Cherie Black, City Secretary <br />
