<br />. <br /> <br />e <br /> <br />RESOLUTION NO. 89-19 <br /> <br />A RESOLUTION ESTABLISHING GUIDELINES AND CRITERIA GOVERNING TAX <br />ABATEMENT AGREEMENTS BY THE CITY OF LA PORTE; FINDING COMPLIANCE <br />WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br /> <br />Section 1. The City Council of the City of La Porte hereby <br />adopts the attached "Model Guidelines And Criteria For Granting Tax <br /> <br />Abatement In A Reinvestment Zone Created In Harris County" as <br />adopted and recommended by the Harris County Commissioners Court, in <br /> <br />compliance with Section 312.002, Tax Code, as amended by Senate Bill <br /> <br />1312, of the 7lst Legislature. These guidelines and criteria are <br /> <br />attached hereto as Exhibit "A", and incorporated by reference herein <br /> <br />for all purposes. <br /> <br />Section 2. The adoption of the guidelines and criteria by the <br /> <br />City Council of the City of La Porte does not: <br />a) limit the discretion of the City Council of the City of La <br /> <br />Porte to decide whether to enter into a specific tax <br /> <br />abatement agreement; <br /> <br />b) limit the discretion of the City Council of the City of La <br /> <br />Porte to delegate to its employees the authority to <br /> <br />determine whether or not the governing body should consider <br /> <br />a particular application or request for tax abatement; or <br /> <br />c) create any property, contract, or other legal right in any <br /> <br />person to have the City Council of the City of La Porte <br /> <br />consider or grant a specific application or request for tax <br /> <br />abatement. <br /> <br />Section 3. The City Council of the City of La Porte hereby <br /> <br />establishes the policy of the City of La Porte, that tax abatement <br /> <br />agreement applications will not be accepted for areas within the <br /> <br />Battleground Industrial District and the Bayport Industrial District <br /> <br />of the City of La Porte. However, as to any portion of such areas <br /> <br />which are not within the corporate limits of the City of La Porte, <br /> <br />Harris County Commissioners Court may establish tax abatement <br /> <br />agreements for the benefit of itself, and taxing units other than <br />the City of La Porte having jurisdiction over said area. <br />
