<br />. <br /> <br />e <br /> <br />RESOLUTION NO. 78-01 <br /> <br />. <br /> <br />A RESOLUTION SUPPORTING SENATE BI"LL NO. 381. <br /> <br />WHEREAS, the property along the waterfront is being <br /> <br />severely damaged because of the sinking of the land; and <br /> <br />WHEREAS, this area is suffering an unnatural phenomenon <br /> <br />due to the sinking of the land; and <br /> <br />WHEREAS, this phenomenon is not a direct result of <br /> <br />neglect by the waterfront property owners and they should <br /> <br />not lose their property because of the sinking land; and <br /> <br />WHEREAS, many owners of waterfront property are denied <br /> <br />. <br /> <br />its use because they cannot reclaim eroded or sinking land <br /> <br />by using bulkheads and filling behind them; and <br /> <br />WHEREAS, the enforcement of this law amounts to confis- <br /> <br />cation of property without due process of law; and <br /> <br />WHEREAS, Public Law 92-500 will result in unwarranted <br /> <br />intrusion by the Federal Government on property owner's rights, <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF LA PORTE, TEXAS <br /> <br />THAT, the City supports the theory that land erosion and <br /> <br />submerging due to subsidence was never intended to come under <br /> <br />the laws which deal with nature's ordinary erosion and sub- <br /> <br />. <br /> <br />merging of land; and <br />THAT, the City of La Porte supports Senate Bill 381 <br /> <br />which would amend Public Law 92-500 and which would return <br /> <br />to the owner that property which has been damaged due to <br /> <br />subsidence and erosion and allow reclamation of same. <br /> <br />PASSED AND APPROVED this 9th day of January, 1978. <br /> <br />CITY OF LA PORTE <br /> <br />I!Y 0~- <br /> <br />J.
