R?-l? <br /> <br />. <br /> <br />A RESOLUTION OF THE CITY OF LA PORTE, TEXAS, RATIFYING AND <br />AUTHORIZING ITS PARTICIPATION IN THE COALITION OF CITIES <br />WITH ORIGINAL JURISDICTION TO INCLUDE DATA SHARING AND INTER- <br />VENTION WITH SAID COALITION IN THE HL&P RATE REQUEST, DOCKET <br />NO. 4540, BEFORE 'I'HE TEXAS PUBLIC UTILITIES COMMISSION. <br /> <br />WHEREAS, on June 16, 1982, the Houston Lighting and Power <br /> <br />Company (HL&P) filed a Statement of Intent to change its rates <br /> <br />for electric service within the City of La Porte, Texas, and <br /> <br />throughout its service area and has requested that said changes <br /> <br />become effective on July 22, 1982; and <br /> <br />WHEREAS, the Public Utilities Commission of Texas has <br /> <br />original jurisdiction over said rate request within the unin- <br /> <br /> <br />~ corporated areas of the service area; and <br /> <br />WHEREAS, the City of La Porte, Texas, has original juris- <br /> <br />diction over said rate request within its corporate limits; and, <br /> <br />WHEREAS, the complexities of the issues and. the magnitude <br /> <br />of the requested rate increase requires extensive study, data <br /> <br />and analysis for the City to responsibly exercise its original <br /> <br />jurisdiction and protect the general w~lfare.of all ratepayers; <br />residential, commercial and industrial; within'its boundaries; <br /> <br />and, <br /> <br />WHEREAS, historical precedent has shown that the systern- <br /> <br />wide rate imposed under current procedures before the PUC results <br /> <br />~ in the virtual nullification of City Council action and eliminates <br /> <br />any meaningful impact of the City I S exercise of its .legislated <br /> <br />original jurisdiction on the rate-making process; and, <br /> <br />WHEREAS, the City of La Porte, .Texas, desires to cooper.ate <br /> <br />in a joint effort with other cities with original jurisdiction <br /> <br />to provide for adequate analysis of the issues raised by the. <br /> <br />rate change request and to establish or restore real authority <br /> <br />and a genuine impact on the rate setting process to municipalities <br /> <br />with original jurisdiction; and, <br /> <br />." <br />
