<br />. <br /> <br />. <br /> <br />RESOLUTION NO. 85-3 <br /> <br />WHEREAS, the ~itizens of Texas and the State Legislature in <br />19l3 voted to give citizens the right of self determination <br />through the creation of home rule cities; and <br /> <br />WHEREAS, cities around the state have exercised this <br />authority in a judicious and careful manner since being granted <br />,that authority; and <br /> <br />WHEREAS, cities have used this authority to respond to <br />citizen concerns for regulation of billboards for the health <br />and safety of their community through the passage of ordinances <br />which establish billboard standards and require non-conforming <br />billboards to be removed after completion of an equitable <br />amortization period; and <br /> <br />WHEREAS, the ability of cities to utilize amortization as <br />a means of billboard regulation has been upheld numerous times <br />in state and federal court; and <br /> <br />WHEREAS, the billboard industry is proposing legislation <br />which would eliminate the use of amortization by requiring cash <br />payments prior to the removal of non-conforming billboards; <br /> <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF <br />THE CITY OF LA PORTE, <br /> <br />RESOLVES, that the proposed billboard legislation is not <br />in the best interest of the citizens of Texas because of the <br />threat it poses to the doctrine of local self determination; and <br /> <br />BE IT FURTHER RESOLVED, that the Legislature of the State <br />of Texas be asked to oppose H.B. 1330 and S.B. 897. <br /> <br />PASSED AND APPROVED THIS THE 20th day of March, 1985. <br /> <br /> <br />ATTEST: <br /> <br />~Md <br /> <br />City Secretary <br /> <br />APPROVED, ~ <br />~t5rJ ' ' <br /> <br />City Attorney <br />
