<br />. <br /> <br />. <br /> <br />RESOLUTION NO. 92-1 <br /> <br />WHEREAS, the City Council of the City of La Porte has found and <br /> <br />determined that public necessity requires the location of a ten foot <br /> <br />(10') wide public water line easement on the hereinafter described <br /> <br />real property, in the City of La Porte, Harris County, Texas; and <br /> <br />WHEREAS, the City Council of the City of La Porte has found and <br /> <br />determined that a ten foot (10") wide easement over and across the <br /> <br />hereinafter described real property is suitable and needed for such <br /> <br />purpose, and that it is necessary to acquire same for a public water <br /> <br />line easement; <br /> <br />WHEREAS, the City Council of the City of La Porte deems it <br /> <br />advisable to authorize, and does hereby authorize, Knox W. ASkins, <br /> <br />City Attorney of the City of La Porte, to represent the City of La <br />Porte in the acquisition of the hereinafter described property: <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LA PORTE: <br /> <br />That the said Knox W. Askins, as City Attorney for the City of <br /> <br />La Porte, be and he is hereby, authorized to negotiate with the <br />owners of the hereinafter described land, concerning the acquisition <br /> <br />by the City of La Porte, of the perpetual right, privilege and <br /> <br />easement, with appropriate rights of ingress and egress and <br /> <br />reasonable working area for construction and maintenance, to enter <br /> <br />upon and construct, reconstruct, maintain, operate, inspect, <br /> <br />replace, repair and remove, a twelve inch (12") water line and <br /> <br />facilities, over and across the hereinafter described property, and <br /> <br />located in Harris County, Texas, said easement being more <br /> <br />particularly described as a ten foot (10') wide strip of land, <br /> <br />immediately south of and contiguous to the right-of-way of Spencer <br /> <br />Highway, based on one hundred feet (100') right-of-way width, the <br /> <br />property being burdened with said ten foot (10') wide water line <br /> <br />easement being more particularly described as follows, to wit: <br /> <br />Lots 28, 29, and 30, Block 2, Spenwick Place, <br />Section One (1), an addition in Harris County, <br />Texas, according to the map or plat recorded in <br />Volume 42, Page 64 of the Map Records of Harris <br />County, Texas; <br />
