<br />. <br /> <br />. <br /> <br />RESOLUTION NO. 92- 08 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA PORTE, <br />ESTABLISHING A POLICY FOR SEWER CONNECTIONS FOR STRUCTURES WHICH <br />WERE IN EXISTENCE ON JANUARY 1, 1990 OR FOR WHICH A BUILDING PERMIT <br />WAS ISSUED PRIOR TO NOVEMBER 13, 1990; FINDING COMPLIANCE WITH THE <br />OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br /> <br />Sec~ion 1. The City Council of the City of La Porte, at its <br /> <br />regular meeting of October 12, 1992, approved a contract for the <br /> <br />construction of sewer main extensions, to serve certain properties <br /> <br />within the City of La Porte which had not previously had available <br /> <br />sanitary sewer service. The properties to be served with the new <br /> <br />sanitary sewer mains are now served by private septic tank systems. <br /> <br />section 2. The City Council of the City of La Porte, by <br /> <br />passage of this Resolution, establishes the following policy for <br /> <br />sanitary sewer connections to structures which were in existence <br /> <br />prior to January 1, 1990, or a building permit issued prior to <br /> <br />November 13, 1990. Any owner of property on which a structure was <br /> <br />in existence prior to January 1, 1990, or a building permit issued <br /> <br />prior to November 13, 1990, who shall connect such property to a <br /> <br />sanitary sewer main of the City of La Porte when such main is <br /> <br />available within 200 feet of such property, within ninety (90) days <br /> <br />from the date of written notice by the City of La Porte to said <br /> <br />owner to connect to said sanitary sewer main, shall be entitled to <br /> <br />make such sewer connection in accordance with the terms and <br /> <br />provisions of City of La Porte Ordinance No. 759-E, passed and <br />approved by the City Council of the City of La Porte on August 16, <br />1976. After, the ninety (90) day notice period has expired, the <br />current policies, ordinances, and regulations of the City pertaining <br />to sanitary sewer connections shall apply. <br />Sec~ion 3. In addition, any such defined property owner <br />connecting to a City of La Porte sanitary sewer main within said <br />ninety (90) day period, may, at the option of such property owner, <br />pay all fees and charges for such sanitary sewer connection as <br />agreed upon between such defined property owner and the City Manager <br />or his designee, or as hereafter directed by City Council. <br />Such monthly installments shall be collected from such sanitary <br />sewer customer as an additional monthly charge on such customer's <br />City of La Porte water and sewer bill. The deferred payment of such <br />charges shall additionally be secured by a Mechanics' and <br />Materialmen's Lien on said property, in favor of the City of La <br />Porte, which shall be due and payable in full in the event of the <br />
