AND LEGALLY DESCRIBED ASTRAC'"I'S 9-12, BLOCK 85, <br />TOWN OF LA PORTE SUBDIVISION, FROM GENERAL COMMERCIAL (GC) TO <br />LOW DENSITY RESIDENTIAL (R-1),; MAKING CERTAIN FINDINGS OF FACT <br />RELATED TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN <br />MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF; <br />BE ITORDAINfI,11) BY TI -11M° C[TY COUNCII, OFTIJE CITY OF LA PE, TEXAS: <br />Section 1, Chapter 106 "Zoning" of the Code ofOrdinances is hereby amended by changing (lie <br />zoning classification ot'llic following described property, to wit: a 0.28, acre tract of land located <br />on N. I st St., north of W. Tyler St., and legally described asTracts 9-12, Block, 85,Town oft -a <br />Porte Subdivision, 1-farris County, Texas, from (jeneral Commercial (GC) to Low Density <br />Residential (R- 1). <br />Section 2. A] I ordinances or parts of ordinances inconsistent with the terms ofthis ordinance are <br />hereby repealed; provided, however, that Such repeal shall be only to the extent of such <br />inconsistency and in all other respects this ordinance shall be cumulative of other ordinances <br />regulating and governing tile subject matter covered by, this ordinance. <br />Section 3,. Should any section or part ofthis ordinance be held unconstitutional, illegal, or invalid, <br />car the application to any person or circumstance forany reasons thereof ineffective or inapplicable, <br />such unconstitutionality, illegality, invalidity, or ineffectiveness of'such section or part shall in no <br />way affect, impair or invalidate the remaining portions thereof; but as to such remaining portion <br />or portions, the sarne shall beand remain in, full force and effect and to this end tile provisions of <br />this ordinance are declared to be severable. <br />Section 4. The City Council of'f'icially finds, determines, recites and declares that as sufficient: <br />written notice of the date, hour, place and subject of this meeting ofthe City Council is posted at <br />as place convenient to tile public at the City I fall ofthe city, for the time required by law preceding <br />this niecting, as required by Chapter 55 1, TX, Govt Code;and that this meeting has leen open to <br />tile public as required by law at all times during which this ordinance and the SUbJext matter thereof <br />has been discussed, considered and fornlally acted Upon, 'rhe city COUrICil further ratifies, <br />approves and confirms such written notice and the contents and posting thereof*. <br />Section 5. The City Council orthe City of La forte hereby finds that public notice was properly <br />mailed to all oxvners ofall properties located within two hundred feet (200") of the properties under <br />consideration in compliance with code provisions. <br />Section 6. It is directed that the Official Zoning Map ofthe City ot'La forte, Texas be changed to <br />reflect the zoning classification established by this ordinance <br />
