Albrecht, <br />Director of Community Development <br />City of La Porte <br />604 West Fairmont Parkway <br />La Porte, Texas 77571 <br /> <br />Re: Abandonment of utility Easements reserved by La Porte City <br />Ordinance No. 1693 <br /> <br />Dear Joel: <br /> <br />Enclosed are two (2) execution counterparts of an <br />Abandonment and Release of Easements which I have prepared for <br />use in connection with the referenced matter, which has been <br />previously approved as to form and content by Knox Askins. <br />Please arrange to have this instrument signed by Robert T. <br />Herrera, attested, and acknowledged, and after receiving an <br />authorization to abandon letter from HL&P, please forward same to <br />the undersigned by messenger. Along with the completed <br />Abandonment and Release of Easements, you are also requested to <br />enclosed (i) the fully executed utility Easement granting a <br />twenty (20) feet wide water line easement to the City of La <br />Porte, (ii) a letter from the City Manager or Mayor addressed to <br />Charter Title Company advising that the City of La Porte will <br />confirm the abandonment of the subject easements by an ordinance <br />at the next regularly scheduled meeting of the city council (Knox <br />Askins has agreed to prepare such a letter), and (iii) the letter <br />to ICN and Butler & Binion acknowledging that all conditions for <br />the major site plan have been satisfied as to the 18+ acre tract <br />already acquired by ICN. <br /> <br />As we discussed by phone, we anticipate funding on ICN' s <br />construction loan on Tuesday, August 14, 1990, and would like to <br />have all of the matters mentioned in this letter completed and <br />submi tted to the ti tIe company by Monday. Assuming that the <br />necessary permits to move the subject water line and the building <br />permit have been issued by Monday, and provided that you receive <br />
