<br />Building Codes Appeals Board <br />Minutes of February 17,2005 <br /> <br />Members Present: <br /> <br />Tom Campbell, Franc Velez" Ken Schlather, Bruce Compton, John Elfstrom <br /> <br />Members Absent: <br /> <br />Ron Holt, Joe Gold <br /> <br />City Staff Present: <br /> <br />Chief Building Official Debbie Wilmore <br /> <br />1. CALL TO ORDER <br /> <br />Meeting called to order at 6:05 P.M. by Chainnan Tom Campbell <br /> <br />2. CONSIDER APPROVING MINUTES FROM THE JANUARY 25,2005 MEETING <br /> <br />Motion to approve the minutes of the January 25, 2005 meeting as submitted was made by Ken <br />ScbJather. Second was by John Elfstrom. Motion passed unanimously. <br /> <br />3. BRIEFING FROM CITY ATTORNEY'S OFFICE <br /> <br />Clark Askins represented the City Attorney's office and recommended the Board utilize the <br />handout from the City Secretary's office (Handbook for Boards) and Board establishment <br />ordinance #04-2773A. <br /> <br />Mr. Askins discussed how the Open Meetings Act works and cautioned members on meetings <br />without formal postings. He also discussed the role of the Board two-fold: <br />a. Hear appeals based on ordinance criteria <br />b. Review of adopted codes based on ordinance criteria <br /> <br />He asked the Board to be aware of possible conflict of interest. He suggested they read the <br />handbook and become familiar with it. He reminded the Board that all action is subject to the <br />Open Records Act. <br /> <br />John Elfstrom asked how an individual appeals a <kcision. Mr. Askins explained staff receives a <br />request on a standard application and arranges a meeting. <br /> <br />Bruce Compton asked on clarification/confirmation that appeals are decided by the Board and not <br />appealed to the City Council. Mr. Askins confirmed that was correct. <br /> <br />Tom Campbell inquired about interpretations versus code changes. Mr. Askins noted the Board <br />makes interpretations based on criteria in the ordinance. Also, based on ordinance language the <br />Board "recommends" code changes to City Council. At this time, Mr. Askins left the meeting. <br />
