<br />. <br /> <br />. <br /> <br />. <br /> <br />.. <br /> <br />e <br /> <br />e <br /> <br />RESOLUTION NO. 7i-Ol <br /> <br />BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: <br /> <br />Section 1. In order to diminish the great threat to life <br /> <br />and property, represented by the unprotected grade crossing of <br /> <br />the Southern Pacific Railroad at Fairmont Parkway, and the lack <br /> <br />of mechanical gates on the grade crossing at Spencer Highway, <br />the City of La Porte hereby agrees and offers to pay the <br /> <br />Southern Pacific Company one-third (1/3) of the actual cost of <br /> <br />the hereinafter described improvements, but not to exceed Ten <br /> <br />Thousand Dollars ($10,000.00), which shall be payable by the <br /> <br />City to Southern Pacific Company in cash, upon completion of <br /> <br />said improvements, to-wit: <br /> <br />SPENCER HIGHWAY GRADE CROSSING: Add to the existing <br />automatic flashing system and overhead illumination, <br />mechanical gates. <br /> <br />FAIRMONT PARKWAY CROSSING: Construct on the northern <br />lane of Fairmont Parkway, which is now being used for <br />two-way traffic, overhead illumination; automatic <br />flashing signals, and gates. <br /> <br />The City of La Porte shall have no responsibility for the <br /> <br />cost of operation and maintenance of said facilities, and said <br /> <br />facilities shall be operated by the Southern Pacific Company, <br /> <br />its successors or assigns, for so long a period of time as <br /> <br />its railroad trains operate on such crossings. <br /> <br />PASSED AND APPROVED, this the 4th day of January, A.D. 1971. <br /> <br />'\ <br /> <br />CITY OF LA PORTE, TEXAS <br /> <br />By ?fc~m~ <br /> <br />/' <br /> <br /> <br />APPROVED: d. <br />~ ..,J ~ <br /> <br />City Attorney " <br />
