<br />. e <br /> <br />RESOLUTION NO. 71-05 <br /> <br />. <br /> <br />LAND ACQUISITION POLICY STATEMENT <br /> <br />WHEREAS, it falls the duty of the City Commission of <br /> <br />the City of La Porte, Texas, to, from time to time, acquire <br /> <br />land for public purposes, and <br />WHEREAS, it is difficult to find and to negotiate with <br /> <br />some property owners. <br /> <br />NOW, THEREFORE, WE THE MEMBERS OF THE CITY COMMISSION <br />OF THE CITY OF LA PORTE, TEXAS, DO HEREBY RESOLVE TO <br />ADOPT THE FOLLOWING POLICY: <br /> <br />. <br /> <br />1. That, we will make every effort to n~gotiate for <br />the purchase of property for public purposes, and <br />2. That, we will use the power of eminent domain only <br /> <br />as a last resort, and <br /> <br />3. That, we will not require any owner to surrender <br /> <br />possession of any property until we pay, or cause to be <br /> <br />paid, to the owner the ~greed purchase price arrived at by <br />negotiation, or in any case where only the amount of the <br /> <br />payment to the owner is in dispute, not less than seventy- <br /> <br />five (75) percent of the appraised fair value as approved <br /> <br />by the applicant or, if subsequent to HUD concurrence in <br /> <br />. <br /> <br />the acquisition price for the property, as concurred in <br /> <br />by HUD, and <br />4. That, should the property be lawfully occupied at <br /> <br />the time of acquisition, person or persons will be, given <br />at least ninety (90) days written notice of the date on <br /> <br />which possession will be required, and <br />5. That, should the acquisition of any property cause <br /> <br />a person or persons to be displaced, City of La Porte is <br />obligated to find equal or better housi~g for displacee, <br />and <br /> <br />6. That, by this act the City Commission of the City <br /> <br />. <br /> <br />of La Porte, Texas, directs the Administrator to maintain <br /> <br />ATTACHMENT -1- - 2 PAGES <br />
