<br />. <br /> <br />. <br /> <br />ORDINANCE NO. 1000-P-1 <br /> <br />AN ORDINANCE REPEALING ORDINANCE NO. 1000-P OF THE CITY OF LA PORTE, <br />HARRIS COUNTY, TEXAS, AND REVOKING THE PERMIT GRANTED THEREIN: ADOPT- <br />ING CERTAIN FINDINGS OF FACT: FINDING COMPLIANCE WITH THE OPEN MEET- <br />INGS LAW: PROVIDING A SEVERABILITY CLAUSE: AND PROVIDNG FOR AN EFFEC- <br />TIVE DATE HEREOF. <br /> <br />WHEREAS, the City of La Porte has engaged in the regulation of <br />the closing hours for the sale of beer by retailers selling beer for <br /> <br />consumption on premises in accordance with the provisions of Vernon's <br /> <br />Texas codes Annotated, Alcoholic Beverage Code of the State of Texas: <br /> <br />and <br /> <br />WHEREAS, pursuant to said regulations, the City of La Porte on <br /> <br />the 6th day of April, 1983, passed Ordinance No. 1000-P, permitting <br /> <br />the sale of beer during the hours set by the general laws of the <br /> <br />State of Texas, at an establishment used and located as follows, to-wit: <br /> <br />STREET ADDRESS OF PROPERTY: <br /> <br />2199 Underwood <br />La Porte, Texas 77571 <br /> <br />LEGAL DESCRIPTION OF PROPERTY: <br /> <br />A one (1) acre tract out of La Porte Outlot <br />451, Harris County, Texas <br /> <br />NAME OF APPLICANT: <br /> <br />Joseph W. Chadwick <br /> <br />ADDRESS OF APPLICANT: <br /> <br />905 N. Amy <br />Deer Park, Texas 77536 <br /> <br />TRADE OR ASSUMED NAME OF RESTAURANT BUSINESS: <br /> <br />"Sweet Peals Po Boy and Sandwich Shop" <br /> <br />and, <br /> <br />WHEREAS, said Ordinance No. 1000-P specifically required said <br /> <br />establishment, in order to qualify for its on premises beer permit, to: <br /> <br />(I) Derive 65% of its gross income from the sale of <br />prepared food : <br /> <br />(2) Serve beer as a beverage only in connection wi th the <br />service of prepared food to a customer: and <br /> <br />(3) Upon notification from the Building Official of the <br />City of La Porte, provide the City of La Porte, within <br />thirty (30) days from the date of notification, a veri- <br />fied audit for each of the preceding four (4) calendar <br />quarters, showing the gross income derived from the <br />sale of alcoholic beverages and the gross income derived <br />from the sale of food, said audit to be supported by <br />copies of licensee's invoices and cancelled checks: and <br />
