<br />- <br /> <br />. <br /> <br />I <br /> <br />. <br /> <br />e . <br /> <br />ORDINANCE NO. 1007 <br /> <br />AN ORDINANCE DECLARING THE POLICY OF THE CITY OF LA PORTE <br />CONCERNING A PORTION OF CRESCENT DRIVE, IN CRESCENT SHORES <br />SUBDIVISION IN THE CITY OF LA PORTE; AND PROVIDING AN <br />EFFECTIVE DATE HEREOF. <br /> <br />BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LA PORTE: <br /> <br />Section 1. The City Commission of the City of La Porte <br /> <br />hereby finds, determines, and declares, that the hereinafter <br /> <br />described portion of Crescent Drive, in Crescent Shores Sub- <br /> <br />division, situated within the City of La Porte, is not now, <br /> <br />and has never been, open to through pedestrian and vehicular <br /> <br />traffic, to-wit: <br /> <br />That portion of Crescent Drive, in Crescent <br />Shores Subdivision, according to the map or <br />plat thereof, recorded in Volume 8, Page 58, <br />of the Map Records of Harris County, Texas, <br />and being that portion of Crescent Drive <br />situated between Block One (1) and Block Two <br />(2) of Crescent Shores Subdivision, and be- <br />tween the North line of said subdivision, <br />and the North right-of-way line of Edgewood <br />Avenue, extended Easterly. <br /> <br />Section 2. The City Commission of the City of La Porte <br /> <br />hereby finds, determines, and declares, that there is no <br /> <br />public need or necessity for the opening of the hereinabove <br /> <br />described portion of Crescent Drive, to vehicular and pedestrian <br /> <br />traffic, and it is Ordered that the same shall not hereafter <br /> <br />be open to through pedestrian and vehicular traffic. <br /> <br />Section 3. Nothing in this Ordinance shall be construed <br /> <br />as limiting or abridging the easement rights of the City of <br />La Porte, and those public utilities holding franchises with <br /> <br />the City of La Porte, to make full use of the hereinabove <br /> <br />described portion of Crescent Drive, for utility easement <br /> <br />purposes, together with any necessary pedestrian and vehicular <br /> <br />traffic in relation thereto. <br /> <br />Section 4. This Ordinance shall be effective from and <br /> <br />after its passage and approval. <br />
